AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CAS£ NUMB£R

FD-2014-00355

GENERAL: The applicant appeals for an upgrade to her discharge to Honorable, a change to the narrative reason and a change to the reenlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge, change of reason and authority for discharge, and change to the reenlistment code.

ISSUE: The applicant received a General discharge for Misconduct -Minor Disciplinary Infractions

The Air Force Discharge Review Board, under its responsibility to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity i n the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and propriety. The Applicant's record of service included one Article 15 for failure to go to a medical appointment, five Letters of Reprimand for failure to go on time on four occasions, and wearing out of regulation nai l polish whi le in uniform. She also received one Letter of Counseling for failure to complete self-test questions as directed by leadership.

The applicant contends the discharge was inequitable because it was too harsh. She also contends the unacceptable behavior leading to her discharge was an isolated incident within her almost four year of service. After review of the records, the Board found that the member had several other instances of documented disciplinary infractions. The Board opined that through the administrative actions taken, the appl icant had ample opportuni ties to change her negative behavior. The Board concluded the applicanf s misconduct was a significant departure from conduct expected of all mili tary members.

A discharge is upgraded only if the appl icant and the Board can establish that an inequity or impropriety took place at the time of discharge. After a thorough review of the records, the Board found no evidence to warrant an upgrade of the discharge characterization, narrative reason or re-enlistment code.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive req uirements of the discharge regulation, was within the discretion of the discharge authority, and that the applicant was provided full administrative due process.

In view of the foregoing find ings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determi nes the discharge should rema in unchanged.
