AIR FORCE DISCHARGE REV l EW BOARD DECISIONAL RATIONALE

CASE NLIMHRH

FD-2006-0O1 92

GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.

The attached brief contains available pertinent data on thc applicant and the factors leading to the discharge.

FINDINGS: Upgrade of discharge is dcnicd.

The Board finds the applicant submitted no issues coiltestiilg the equity or propriety of the discharge, and
after a thorough review of the record, the Board was unable to identify any that would justify a change of
discharge.

ISSUE:

Issue 1. The applicant submitted no issues contesting the equity or propriety of his discharge and requested
the review be complctcd bascd on the available service record. I lc expressed his desirc for upgrade to
receive his education benefits. The B o d reviewed the cntirc record and fo~md no evidence of impropriety
or inequity in this case on which to base an upgrade of discharge. The records indicated the applicailt
received an Article 15 and two Letters of Reprimand for misconduct. Applicant received an Article 15 for
failure to pay his monthly government travel card in full; receiving a lawful order to immediately remove
pets from his base housing unit and wrongfully maintained one pet, a Rottweiler dog. He was punished with
a reduction in grade to Airman First Class and a reprimand. Tle was administratively disciplined for
disobeying threc written ordcrs, making a false statement, failure to go, failure to control his pets, and failure
to keep government quarters adequately cleaned. 'I'he DRB opined that through these administrative actions,
the applicant had ample opport~~nities
to change his negative behavior. The Board concluded the misconduct
was a significant departure from conduct expcctcd of all military members. 'I'he characterization of the
discharge received by the applicant was found to be appropriatc.

Issue 2. The applicant cited his desire to receive [he G.I. Bill benefits as justification for upgrade. The DRB
noted that when the applicant applicd for these benefits, he signed a statement (DD Form 2366, on
August 19, 1993) that he understood he must receive an Honorable discharge to receive future educational
entitlements. 'I'hc Board was sympathetic to the iinpact the loss o l these benefits was having on the
applicant, but this is not a matter of inequity or impropriety which would warrant an upgrade.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.
