AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE

GENERAL: The applicant appeals for upgrade of discharge to honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge is denied.
The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and
after a thorough review of the record, the Board was unable to identify any that would justify a change of
discharge.
ISSUE:
The applicant submitted no issues and requested that the review be completed based on the available service
record. The Board reviewed the entire record and found 110 evidence of impropriety or inequity in this case
on which to base an upgrade of discharge. Thc records indicated applicant had received an Article 15, a
Vacation, six Letters of Reprimand and a Letter of Counseling for misconduct. The applicant received an
Article 15 for sleeping on post while assigncd as a sentinel at Nighthawk 4. He received a suspended
reduction in grade to Airman, 30 days extra duty and a reprimand. The Vacation was received for failure to
go to appointed place of duty at the United States Air Force firing range. As a result, he was punished with a
reduction in grade to Airman. 'I'he applicant had additional nlisconduct and was administratively disciplined
for failure to obey an order, failure to respond to unannounced alarm activation, reporting to duty with
uniform below standards, failure to go on two separate occasions, and dereliction of duty. The DRB opined
that through these administrative actions, the applicant had ample opportunities to change his negative
behavior. The Board concluded the misconduct was a significant departure from conduct expected of all
military members. The characterization of the discharge received by the applicant was found to be
appropriate.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was coilsistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

1. I am rmmmending your discharge from the United States Air Force for a Pattern of
Misconduct (Conduct Prejudicial to Good Order and Discipline), The authority for this action is
AFPD 36-32 and AFI 36-3208, paragraph 5.50.2. If my recommendation is approved, your
service will be characterized as either Honorable, Under Honorable Conditions (General), or
Under Other Than Honorable Conditions (UOTHC). I am recommending that your service be
characterized as General.
2. My reasons for this action are that:
a, In March 2000, you were operating a motor vehicle without auto
insurance. This vehicle was involved in an accident with a civilian's vehicle. For this
misconduct, you received a Letter of Reprimand, dated 29 Mar 01. (Atch 1)
b. You, did at or near Cheyenne Mountain Air Force Station, Colorado Springs, on or about
10 Jan 01, without authority, fail to go at the time prescribed to your appointed place of duty, to
wit: United States Air Force Academy firing range. For this misconduct, your suspended
nonjudicial punishment from an Article 15, dated 15 Dec 00, was vacated on 2 Feb 0 1.
Punishment consisted of reduction to the grade of airman, with a new date of rank of 15 Dec 00
and was placed in your existing Unfavorable Information File (UIF). (Atch 2)
c. You, on or about 6 Dec 00, at or near Cheyenne Mountain Air Force Station, Colorado,
being posted as a sentinel at Nighthawk 4, were found asleep upon your post. For this
misconduct, you received an Article 15, dated 15 Dec 00, Punishment consisted of reduction to
the grade of airman (suspended until 14 Jun Ol), 30 days extra duty, a reprimand, and the

d. On or about 21 Nov 00, you were derelict in the performance of your duties. For this

higher authority will decide whether you will be discharged or retained in the Air Force and, if
