GENERAL:  The applicant appeals for upgrade of discharge to honorable. 

The applicant was offered a personal  appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade of discharge is denied. 

The  Board  finds  that  neither  the  evidence  of  record  nor  that  provided  by  the  applicant  substantiates  an 
inequity or impropriety that would justify  a change of discharge. 

ISSUES: 

Issue 1.  The applicant contends his discharge was inequitable because it was too harsh.  The records 
indicated the applicant received two Article  15s, two Letters of Reprimand, and two Records of Individual 
Counseling for misconduct.  The misconduct included violating dormitory rules by  allowing his wife and pet 
to live in his dorm room, financial irresponsibility, failure to go, and by making a false official statemcnt to 
the first sergeant by pretending to be his father over the telephone.  The DRB opined that through these 
administrative actions, the applicant had ample opportunities to change his negative behavior.  The Board 
concluded the misconduct was a significant departure from conduct expected of all military members.  The 
characterization of the discharge received by the applicant was found to be appropriate. 

Issue 2. The applicant states that his discharge did not take into account the good things he did while in the 
service. The DRB took note of the applicant's duty performance as documented by his performance reports 
and other accomplishments.  They found the seriousness of the willful misconduct offset any positive aspects 
of the applicant's duty performance.  The Board concluded the discharge was appropriate for the reasons 
which were the basis for this case. 

CONCLUSIONS:  The  Discharge  Review  Board  concludes  that  the  discharge  was  consistent  with  the 
procedural  and  substantive  requirements  of  the  discharge  regulation  and  was  within  the  discretion  of the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings the Board further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge should not be changed.

I am requesting that my discharge be changed from General  (under 

honorable conditions), to Honorable. Even though I was discharged for 
misconduct because I did not agree with certain issues happenirrg in my 
squadron and was to get out of the military, I believe that my mllltary career 
should not be ignored.1 graduated as a Honor Graduate in basic training, and 
then graduated as Top Graduate in my class while I was in tech school. I 
also recieved a Air Force Achievement Metal, and a National Defence Service 
Metal for outstanding performance while deployed at Al Uded Air Base, Qatar 
in support of Operation Enduring Freedom. While state side, I participated in 
numerous comander call's. 1 was a part of adopt-a-highway, and volunteered for 
. numerous aqtivites apund $.he base. After I returned from my deployment, I just 
felt I was done wfkh  that part of my life and was reai3jiT6Tir6vbbon and I drdwliat 
ever I could to get out before my service commitment was up. I feel even though 
I seperated before my time was up,  I did serve my country proudly, and 
honorable, and ask you to change my discharge to honorable, the way I feel it 
should be. I thank you for your consideration in this matter.

SUBJECT:  Notification Memorandum 

1.  I am recommending your discharge from the United States Air Force for minor disciplinary 
infractions.  The authority for this action is AFPD 36-32, Military Retirements and Separations, 
and AFI  36-3208, Administrative Separation ofAirmen, Chapter 5 ,  Section H, paragraph 5.49.  If 
my recommendation is approved, your discharge will be characterized as under honorable 
conditions (General) and you will be ineligible for reenlistment in the Air Force. 

2.  My reasons for this action are: 

a.  On 10 Sep 01, you moved your wife and pet into your dormitory room in direct violation of 

dormitory rules.  For this incident, you received a Letter or Reprimand (LOR), dated 9 Oct 01. 

b.  On 7 May 02, you failed to obey an order to make payments to settle your debt with your 

apartment complex.  For this incident, you received an LOR, dated 16 May 02. 

c.  On  13 Jan 03, you received a summons to appear in court for non-payment of your rent. 
Even though you had set up an allotment, you did not follow up to ensure your rent was being 
paid.  For this incident, you received a Record of Individual Counseling (FUC), dated 14 Jan 03. 

d.  On 11 Feb 03,  the unit was notified that you were $3,708.00 behind on your rent and that 
your apartment complex had ordered your eviction.  You again received a RIC, dated 12 Feb 03, 
documenting your financial irresponsibility. 

e.  On  7 Mar 03, you failed to go to your appointed place of duty.  For this incident you 

received an Article 15, dated 9 Apr 03, with a punishment of reduction to the rank of Airman 
First Class (suspended), 45 days extra duty, and a reprimand.  This action established your 
Unfavorable Information File (UF). 

f.  On 16 Oct 03, you failed to report back from your leave and you made a false official 

statement when you stated with the intent to deceive to your supervisor over the phone that you 
were your father and that "Adam7' had left two days ago,  For these incidents, you received an 
Article 15, dated 3 Nov 03, with a punishment of reduction to the grade of Airman First Class, 
forfeiture of $100.00 pay per month fox 2 months, and 20 days extra duty (1 0 day suspended).
