GENERAL:  The applicant appeals for upgrade of discharge to honorable. 

The applicant was offered a personal  appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

Thc attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  The Board grants the requested relief. 

The  Board  finds  that  neither  the  evidence  of  record  nor  that  provided  by  applicant  substantiates  an 
impropriety  that  would  justify  a  change  of  discharge.  However,  based  upon  the  record  and  evidence 
provided by applicant, the Board finds the applicai~t's character of discharge is inequitable. 

ISSUE: 

'She applicant was discharged with an under honorable conditions (general) discharge for minor disciplinary 
infractions in December 2004.  Applicant had an Article  15, two Lcttcrs of Reprimand, a Letter of 
Counseling, a Letter of Admonishment and a Record of Individual Counseling for misconduct.  Applicant 
contends discharge was inequitable because it was not based on medical expert statements but was based on 
commander's views.  Applicant contends he was prescribed an acne medication which resulted in applicant 
having side effects.  As a result, he was being treated for depression.  After a thorough and complete 
consideration of the information submitted by the applicant, information contained in his record, the Board 
concluded there was significant mitigation and extenuation to substantiate upgrade of the discharge to 
honorable. 

CONCLUSIONS: 
'Ihe  Discharge  Review  Board  concludes  that  the  discharge  was  consistent  with  the 
procedural  and  substantive rcquirelnents  of the  discharge regulation  and  was  within  the  discretion  or the 
discharge authority and that the applicant was provided full administrative due process. 

However, in view of the foregoing findings, the Board further concludes that the overall quality of 
applicant's  service is more accurately reflected by an Honorable discharge.

SUBJECT:  Notification Memorandum

1.  I am recommending your discharge from the United States Air Force for misconduct:  minor 
disciplinary infractions.  The authority for this action is AFPD 36-32, Militwy Retirements and 
Separations, and AFI  36-3208, Administrative Separatkn ofAimten, paragraph 5.49.  If my 
recommendation is approved, your service will be characterized as an Under Honorable Conditions 
(General) Discharge.  I am recommending that your service be characterized as an Under 
Honorable Conditions (General) Discharge. 

2.  My reason for this action is: 

a.  Between on or about 30 Aug 04 and 2 Sep 04, you were incapable of performing your duties 
due to excessive indulgence in intoxicating liquors.  Specifically, on 29 Aug 04, your blood alcohol 
level was determined to be ,245, resulting in you being admitted to the Intensive Care Unit and 
being placed on life support equipment.  For this incident, you received a Letter of Reprimand, 
dated 18 Nov 04. 

b,  On 2 Nov 04, you went frQm your appointed place of duty without authority and did remain 
absent until apprehended on 13 Nov 04.  For this incident, you received Nonjudicial Punishment, 
dated 30 Nov 04. 

c.  On 30 Jun 04, you failed to return to your duty section upon release of your escort duties.  1n 
addition, on 1 Jul04, you failed to report for duty at the time prescribed.  For these incidents, you 
received a Letter of Reprimand, dated 7 Jul04. 

d,  On 5 Mar 04, you failed your dorm room inspectian. For this incident, you received a 

Record of Individual Counseling, dated 14 Mar 04. 

e.  Between 3 Jul03 and 17 Jul03, you failed to follow a direct order to study your Career 
Development Course (CDC) one hour each day.  For these incidents, you received a Letter of 
Counseling, dated 28 Jul03. 

f. On 5 Apr 03, you received a citation for committing an illegal left turn from Wilbur Wright 
Drive and out the West Gate.  On 8 Apr 03, you were verbally counseled about your actions being 
detrimental to your safety and the safety of others.  Howevei, on  15 Apr 04, you received a citation 
for losing traction while traveling southeast on Davis Ave East.  For this incident, you received a 
Letter of Admonishment, dated 2 1 Apr 03.
