GENERAL:  The applicant appeals liir upgrade of discharge to honorable. 

The applicarit was offered a personal appearance hel'ore thc Discharge Kcvicw Board (DM) and schedulccl a 
personal  appearance via vidco tclcconference, but failed to appear. 

The following additional cxhibits wcrc submitted at the hearing:

The attached brief contains availablc pcrtinent data on the applicant and thc factors leading to the discharge. 

FINDINGS:  Upgrade of discharge is denied. 

The  Board  finds  that  neilher  thc  cvidcnce  of record  1Jor that  providcd  by  thc  applicant  substantiates  an 
inequity or impropriely that wcluld justify a change of discharge. 

ISSUE: 

Issue  1.  Applicant statcs that his discharge did not takc into account the good things hc did whilc in the 
service.  Specilicaliy, he noted  hc was discharged 3 weeks prior to his original date of separation, had scrvcd 
ovcr 95% of his enlistmenl, and was altcady scheduled  to separate voluntarily.  'I'he DRB took note of the 
applicant's duty performance as documented by his pcrforrnance repoi-ts, letters of rccon~mendation and 
other accomplisluncnts.  T'hey found the seriousncss of the willful misconduct nffsct  any positive aspects 01- 
lhe applicant's  duty pcrfonnance.  The Roard concluded the discharge was appropriatc for the reasons which 
were thc basis for this case. 

Issue 2.  'fhc applicant cited the stress he faccd at thc time of his dischargc hccause of personal conllicts he 
was experiencing with his wife.  In addition, he stated thc aftermath of one incident with his spouse directly 
caused the events which became thc basis of his secutld punishment under Article  15, IJCMJ.  'l'hc  Uoard 
was sympathetic to the inlpact of his marital difficulties, but concluded that thc characterization of the 
applicant's  dischargc was appropriate due to thc misconduct. 

'I'he  Ilischal-ge Revicw  Board  concludes  that  thc  discharge  was  crinsislent  with  the
