GENERAL: The applicant appeals for upgrade of discharge to general.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: The discharge is upgraded to general.
The board finds that neither evidence of record nor that provided by the applicant substantiates an
impropriety, which would justify a change of discharge. However, after a thorough review of the record, the
Board finds that the applicant's character of discharge is inequitable.
ISSUE: Applicant contends his discharge was inequitable because it was based on one isolated incident in
30 months of service. The records indicated the applicant received an Article 15 for wrongful use of
marijuana on one occasion. He was punished with reduction in rank to airman basic, forfeiture of $400.00
pay and five days of extra duty. This action led to his administrative discharge in accordance with AFI 36-
3208. The records indicate no other infractions or misconduct by the applicant. While the DRB did not
condone the applicant's drug use, they did fccl it would have been more equitable to give him a General
discharge.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
However, in view of the foregoing findings, the Board further concludes that the overall quality of
applicant's service is more accurately reflected by a General discharge. Therefore, the applicant's
characterization for discharge should be changed to General.
