GENERAL: The applicant appeals for upgrade of discharge to Honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge is denied.
The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.
ISSUE:
Issue 1. Applicant contends that he made a severe error in judgment and kept company with the wrong
crowd; prior to incidents he did not have any derogatory information on him. The record indicates the
applicant was convicted by a Special Court Martial for the wrongful use of marijuana and lysergic acid
diethylamide (LSD). The Board took note of the applicant's duty performance as documented by his
performance reports, letters of recommendation and other accomplishments. They found the seriousness of
the willful misconduct offset any positive aspects of'the applicant's duty performance and concluded the
misconduct was a significant departure froin conduct expected oSall military members. The characterization
of the discharge received by the applicant was So~lnd to be appropriate.
Issue 2. Applicant states he has applied with the City of Chattanooga as a firefighter but can not be
considered with his current discharge. The Board was sympathetic to the impact the discharge is having on
the applicant's ability to obtain suitable employment, but this is not a matter of inequity or impropriety
which would warrant an upgrade.
CONCLUSIONS:
'I'he Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

upgrade of discharge, thus the applicant's discharge should not be changed.

SUBJECT: ~otifikation Memorandum
1. I am recammending your discharge from the United States Air Force based on drug abuse.
The authority for this action is AFPD 36-32, Military Retirements and Separations, and AFI 36-
3208, Administrative Separation of Airmen, paragraph 5.54, If my recommendation is approved,
then your service will be characterized as Honorable or General (Under Honorable Conditions).
I am recommending that your service be characterized as General.
2. My reason for this action is: between on or about 1 Sep 98 through on or about 30 Sep 98,
you wrongfully used marijuana and between on or about 1 Sep 99 through on or about 31 Oct 99,
you wrongfully used LSD (Lysergic Acid Diethylamide). For this misconduct, you received a
General Court Martial, with punishment consisting of confinement for three months, a reduction
in grade to Al3, and forfeiture of $500 per month for three months. In addition, I initiated your
UIF for this conduct. (See Atchs l a and lb.)
3. I have attached copies of the documents to be forwarded to the separation authority in
support of this recommendation. The commander exercising Special Court-Martial (SPCM)
jurisdiction or a higher authority will decide whether you are discharged or retained in the Air
Force, and if you are discharged, how your service will be characterized. If you are discharged,
then you will be ineligible for reenlistment in the Air Force and will probably be denied
enlistment in any component of the armed forces. Any special pay, bonus, or education
assistance funds may be subject to recoupment.
4. You have the right to consult legal counsel. Military legal counsel is available for you. You
may consult the Area Defense Counsel, by calling DSN 984-2240 or COM 253-974-2240. You
may consult civilian counsel at your own expense.
5. You have the right to submit statements in your own behalf. Any statements that you want
the separation authority to consider must reach me by 2 j ;T;// RO
(six workdays)
unless you request and receive an extension for good cause. I will forward any such statements
to the separation authority.
6. If you fail to consult counsel or to submit statements in your own behalf, then your failure
will constitute a waiver of your right to do so.
7. Upon your release from confinement, you must report to either your section commander or
first sergeant who will then schedule you for a medical examination and a mandatory Transition
Pre-separation Counseling appointment. You must then report to Physical Exams, building 173,
for your scheduled medical appointment with your medical records and to the Family Support
Center, building 55 1, for your scheduled transition counseling.
8. The Privacy Act of 1974 protects any persona~bformation you furnish in rebuttal. A copy of
AFT 35-3208 is available for your use in the orderly room.
9. Execute the attached acknowledgment and return it to me immediately.
