APPLICANT CONTENDS THAT:
Based upon his active duty service and participation in
Operation DESERT STORM/DESERT SHIELD, he is eligible for the
award of the KLM-SA and KLM-K.
The applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:
The applicant served on active duty from 18 Jul 59 through
31 May 91.
The KLM-SA is awarded to U.S. military personnel who served in
support of Operation DESERT STORM (ODS) between 17 Jan 91 and
28 Feb 91, in one or more of the following areas: the Persian
Gulf; the Red Sea; the Gulf of Oman; that portion of the Arabian
Sea that lies north of ten degrees north latitude and west of
68 degrees east longitude; the Gulf of Aden; or, the total land
areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and
the United Arab Emirates.
On 4 May 12, AFPC/DPSIDR notified the applicant of their
determination of his entitlement for the KLM-K.
The remaining relevant facts pertaining to this application are
described in the letter prepared by the Air Force office of
primary responsibility which is included at Exhibit C.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial, indicating there is no evidence
of an error or injustice. The applicant is requesting
entitlement to the KLM-SA. The applicant’s records indicate he
served in the area of responsibility from 17 Dec 90 to
20 Dec 90, prior to the inclusive dates (between 17 Jan 91 and
28 Feb 91) for award of the KLM-SA. Therefore, he does not meet
the eligibility criteria for award of the KLM-SA.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant provides an expanded statement in which he explains
he flew a qualifying mission in support of ODS during the
inclusive period for the KLM-SA. In support of his response, he
also provides copies of a DD Form 1351-2, Travel Voucher or
Subvoucher, covering the period 16 Feb 91 to 24 Feb 91 which
confirms he was in Incirlik, Turkey on 18 and 19 Feb 91, and his
flight records which show he flew KC-135 missions from Incirlik,
Turkey on 18 and 19 Feb 91 (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was untimely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. The
applicant contends he qualifies for The Kuwait Liberation Medal-
Saudi Arabia (KLM-SA) based upon his participation in Operation
DESERT STORM. After a thorough review of the evidence of record
and the applicant’s submission, we believe a preponderance of
the evidence supports corrective action. We note the comments
of AFRC/DPSIDR stating that based upon their review of the
applicant’s official record, they could not verify his
eligibility for the KLM-SA. However, we find the documentation
the applicant submitted with his 29 May 12 letter sufficiently
establishes his participation in operational missions in support
of Operation DESERT STORM. Therefore, we recommend his records
be corrected as indicate below.

The pertinent military records of the Department of the Air
Force relating to the APPLICANT be corrected to show that he was
awarded the Kuwait Liberation Medal-Saudi Arabia (KLM-SA).
