APPLICANT REQUESTS THAT:
His records be corrected to reflect he was awarded the Kuwait
Liberation Medal, Kingdom of Saudi Arabia (KLM-SA) and the Kuwait
Liberation Medal-Government of Kuwait (KLM).

APPLICANT CONTENDS THAT:
He served in support of Operations DESERT SHIELD/DESERT STORM from 16
Jan 91 to 14 Jul 91.
In support of his request, the applicant provides a copy of his DD
Forms 214, Certificate of Release or Discharge From Active Duty, DD
Form 1610, Request and Authorization For TDY Travel of DOD Personnel,
a letter from the National Personnel Research Center (NPRC) and a
letter from the applicant to the NPRC.

STATEMENT OF FACTS:
The relevant facts pertaining to this application are contained in the
letter prepared by the appropriate office of the Air Force.
Accordingly, there is no need to recite these facts in this Record of
Proceedings.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denial as the applicant is not entitled to
the KLM-SA and KLM-K because the Directorate of Assignments was unable
to verify he was deployed to either Saudi Arabia or Kuwait.
DPSIDR notes service members are eligible for the KLM-SA if they
served in support of Operation DESERT STORM between 17 Jan 91 and 28
Feb 91, in one or more of the following areas: the Persian Gulf, Red
Sea, Gulf of Oman, that portion of the Arabian Sea that lies north of
10 degrees north latitude and west of 68 degrees east longitude, Gulf
of Aden, or the total land areas of Iraq, Kuwait, Saudi Arabia, Oman,
Bahrain, Qatar, and the United Emirates.
DPSIDR further notes service members are eligible for the KLM-K if
they served in support of Operations DESERT STORM and DESERT SHIELD
between 17 Jan 91 and 28 Feb 91, in one or more of the following
areas: the Persian Gulf, Red Sea, Gulf of Oman, that portion of the
Arabian Sea that lies north of 10 degrees north latitude and west of
68 degrees east longitude, Gulf of Aden, or the total land areas of
Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant 26
Nov 10, for review and comment within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After careful consideration of
the applicant's request and the available evidence of record, we find
insufficient evidence of error or injustice to warrant corrective
action. The facts and opinions stated in the advisory opinion appear
to be based on the evidence of record and have not been adequately
rebutted by applicant. Absent persuasive evidence applicant was
denied rights to which entitled, appropriate regulations were not
followed, or appropriate standards were not applied, we find no basis
to disturb the existing record.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
