APPLICANT REQUESTS THAT: 

 

His DD Form 214, Certificate of Release or Discharge from Active 
Duty, be corrected to show that he was awarded the Kuwait 
Liberation Medal-Saudi Arabia (KLM-SA), Kuwait Liberation Medal – 
Kuwait (KLM-K), and the Southwest Asia Service Medal (SWASM).

APPLICANT CONTENDS THAT: 

 

He served in the designated war zone; and believes his record are 
in error due to an oversight by the administrative clerk who 
typed his DD Form 214 or that the awards were not in the system 
at the time of his discharge.

STATEMENT OF FACTS: 

 

The applicant served on active duty in the Air Force 15 Oct 79 to 
11 Sep 92. 

 

His DD Form 214 indicates that he served from 2 Aug 90 through 
23 Feb 91 in support of Operation Desert Shield/Storm.

AIR FORCE EVALUATION: 

 

AFPC/DPSID recommends denial. DPSID states after a thorough 
review of the applicant’s official military record, they were 
unable to locate any documentation verifying the applicant served 
in the area of eligibility (AOE) for award of the KLM-K, KLM-SA, 
or the SWASM. 

 

To be eligible for the KLM-SA, U.S. military personnel must have 
served in support of Operation DESERT STORM between 17 Jan 91 and 
28 Feb 91, in one or more of the following areas: the Persian 
Gulf; Red Sea; Gulf of Oman; that portion of the Arabian Sea that 
lies north of 10 degrees north latitude and west of 68 degrees 
east longitude; Gulf of Aden; or, the total land areas of Iraq, 
Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and United Arab 
Emirates. 


 

To be eligible for the KLM-K personnel must have served in 
support of Operations DESERT SHIELD, DESERT STORM, PROVIDE 
COMFORT, or the Cease Fire Campaign between 2 Aug 90 and 31 Aug 
93, in one or more of the following areas: the Persian Gulf; Red 
Sea; Gulf of Oman; that portion of the Arabian Sea that lies 
north of 10 degrees north latitude and west of 68 degrees east 
longitude; Gulf of Aden; or, the total land areas of Iraq, 
Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and United Arab 
Emirates. 

 

Individuals authorized for award of the SWASM must have served in 
support of Operations DESERT SHEILD, DESERT STORM, PROVIDE 
COMFORT, or the Cease Fire Campaign in one or more of the 
following areas from 2 Aug 90 through 30 Nov 95: the Persian 
Gulf; Red Sea; Gulf of Oman; that portion of the Arabian Sea that 
lies north of 10 degrees north latitude and west of 68 degrees 
east longitude; Gulf of Aden; or, the total land areas of Iraq, 
Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and United Arab 
Emirates.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 

 

On 23 Oct 12, a copy of the Air Force evaluation was forwarded to 
the applicant for review and comment within 30 days. To date, a 
response has not been received (Exhibit C).

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by existing 
law or regulations. 

 

2. The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file. 

 

3. Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice. We took notice 
of the applicant's complete submission in judging the merits of 
the case; however, we agree with the opinion and recommendation 
of the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion that the applicant has 
not been the victim of an error or injustice. Although the 
applicant’s DD Form 214 reflects that he served from 2 Aug 
90 through 23 Feb 91, in support of Operation DESERT 
SHIELD/STORM; there is no evidence in his master personnel 
records, nor did he provide any evidence that would validate he 
served in the areas of eligibility for award of the KLM-SA, KLM-K 
or the SWASM. Therefore, in the absence of evidence to the 
contrary, we find no basis to recommend granting the relief 
sought in this application.

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
