APPLICANT REQUESTS THAT:
His records be corrected to show he was awarded the Southwest Asia
Service Medal (SWASM), Kuwait Liberation Medal Kingdom of Saudi Arabia
(KLM-SA), and the Kuwait Liberation Medal Government of Kuwait (KLS-K)
in support of Operation Desert Shield/Storm.

APPLICANT CONTENDS THAT:
He was deployed to Yakota Air Base, Japan during Operation Desert
Shield/Storm to assist the 374th Tactical Airlift Wing.
In support of his request, the applicant submits excerpts from his
military personnel records, a copy of his DD Form 214, Certificate of
Release or Discharge from Active Duty and a copy of the criteria for
the SWASM, KLM-SA, and KLS-K medals.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 15 March 1985 and
was progressively promoted to the grade of sergeant (E-4). He
separated on 28 February 1994.
His DD Form 214 reflects award of the National Defense Service Medal,
and the Air Force Good Conduct Medal w/1 Oak Leaf Cluster. He served
a total of 8 years and 11 months and 16 days of active duty service.
The SWASM, authorized by Executive Order 12754, 12 March 1991, is
awarded to members of the US Armed Forces who served in support of
Operations Desert Shield or Desert Storm between 2 August 1990 and 30
November 1995 in one or more of the following areas; Persian Gulf, Red
Sea, Gulf of Oman, Gulf of Aden, that portion of the Arabian Sea that
lies north of 10 degrees N latitude and west of 68 degrees E
longitude, and the land areas of Iraq, Kuwait, Saudi Arabia, Oman,
Bahrain, Qatar, and the United Arab Emirates; or individuals serving
Egypt, Israel, Turkey, Syria, and Jordan (including territorial
airspace and waters) directly supporting combat operations between 17
January 1991 and 30 November 1995.
To be eligible for the KLM-SA, personnel must have; served in support
of Operation Desert Storm between 17 January 1991 and 28 February
1991, in one or more of the following areas; the Persian Gulf; Red
Sea; Gulf of Oman; that portion of the Arabian Sea that lies N of 10
degrees N latitude and W of 68 degrees E longitude; Gulf of Aden; or,
the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain,
Qatar, and United Arab Emirates.
To be eligible for the KLM-K, personnel must have served in support of
Operations Desert Shield and Desert Storm between 2 August 1990 and 31
August 1993. Eligible personnel had to be in one or more of the
following areas: the Persian Gulf; Red Sea; Gulf of Oman; that porting
of the Arabian Sea that lies N of 10 degrees N latitude and W of 68
degrees E longitude; Gulf of Aden; or, the total land areas of Iraq,
Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and United Arab Emirates.

AIR FORCE EVALUATION:
DPPPR recommends denial. DPPPR states after a thorough review of
applicant’s military record and resources available, they were unable
to verify applicant was in the area of eligibility in support of
Operation Desert Shield/Storm. He provided an enlisted Performance
Report indicating he was at Yakota Air Base, Japan in support of
Operation Desert Shield/Storm from 20 January 1991 to 24 February
1991. On 6 June 2006, he was sent the criteria for each award through
the Congressional Office. No source documents were found in his
military record to substantiate his claim that he was in the area of
eligibility and he did not provide documents to support his claim;
such as a travel voucher. His DD Form 214 reflects Foreign Service to
Elmendorf AFB, Alaska and Yakota Air Base, Japan; therefore, they are
unable to verify entitlement to the SWASM, KLM-SA, and the KLM-K.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 9
Feb 07, for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. The applicant has not
submitted, nor does his military records contain evidence of his
eligibility for award of the SWASM, KLM-SA, and KLM-K medals. We note
no evidence has been presented to verify the applicant was in the area
of eligibility in support of operation Desert Shield/Storm. We agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion
that the applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
