IN THE MATTER OF: DOCKET NUMBER: BC-2010-00248

 INDEX CODE: 107.00

 COUNSEL: NONE

 HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

His records be corrected to show he was awarded the Air Force
Commendation Medal (AFCM).

_________________________________________________________________

APPLICANT CONTENDS THAT:

He recently contacted an old supervisor and discovered he had
been approved for the AFCM. He was discharged prior to the medal
being awarded and added to his DD Form 214, Certificate of
Release or Discharge from Active Duty. During his period of
service, he was presented with various awards and maintained a
professional attitude. Upon his arrival to Korea, he was awarded
the Airman of the Month after being there only two months. He
was very active in volunteering with the American Red Cross and
taught first aid and cardiopulmonary resuscitation (CPR) classes
to service members and their families.

In support of his request, the applicant submits a personal
letter, copies of his DD Form 214, and various letters of
appreciation and certificates of recognition.

The applicant’s complete submission, with attachments, is at
Exhibit A.

having assumed that grade effective and with a date of rank of
1 June 1980. He was honorably discharged from the Air Force on
10 December 1981. He served 3 years, 11 months and 7 days of
total active service.

AIR FORCE EVALUATION:

AFPC/DPSIDR recommends denial. DPSIDR states they are unable to
locate any source documentation to verify his entitlement to the
AFCM. The recommendation for the award must be made by someone,
other than the applicant, preferably the commander or supervisor
at the time of the act or achievement, with firsthand knowledge
of the applicant’s accomplishments. No official documentation
was provided by the applicant to justify the entitlement.

The complete DPSIDR evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant
on 2 April 2010, for review and comment within 30 days. As of
this date, no response has been received by this office (Exhibit
D).

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.

3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. After reviewing
the evidence of record, we are unpersuaded that the applicant's
records are in error or that he has been the victim of an
injustice. We took notice of the complete submission in judging
the merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
basis to recommend granting the relief sought in this
application.

_________________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence no considered
with this application.
