1. His records be corrected to reflect his entitlement to the 
Joint Meritorious Unit Award (JMUA). 

 

2. His records be corrected to reflect award of the Bronze Star 
Medal (BSM) (Administratively Corrected).

APPLICANT CONTENDS THAT: 

 

He was presented with the decoration and the award after he 
retired. 

 

In support of the appeal, the applicant provides copies of the 
BSM awards package and the JMUA awards package. 

 

The applicant’s complete submission, with attachments, is at 
Exhibit A.

STATEMENT OF FACTS: 

 

The applicant’s military personnel records indicate that he 
retired in the grade of major on 31 Jul 09, and served a total of 
three years, seven months, and one day of Foreign Service. 

 

On 12 Apr 10, AFPC/DPSIDR informed the applicant that they were 
able to verify his entitlement to the BSM. 

 

The JMUA is awarded to joint activities for meritorious 
achievement or service, superior to that which is normally 
expected, under any of the following conditions: during action in 
combat with an armed enemy of the United States, in a declared 
national emergency situation, or under extraordinary 
circumstances that involve national interest. 

 


On 16 Apr 10, the applicant was notified by HQ AFPC/DPSIDR of his 
entitlement to the Air Force Commendation Medal (AFCM) and the 
Air Force Good Conduct Medal (AFGCM).

AIR FORCE EVALUATION: 

 

AFPC/DPSIDR recommends denial regarding the applicant’s request 
for award of the JMUA. DPSIDR indicates the JMUA was only 
approved for those who served in Baghdad, Iraq and the applicant 
served in Jalalabad, Afghanistan.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 

 

A copy of the Air Force evaluation was forwarded to the applicant 
on 14 Apr 10, for review and comment within 30 days. As of this 
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by existing 
law or regulations. 

 

2. The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file. 

 

3. Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice regarding his 
request for award of the JMUA. We took notice of the applicant's 
complete submission in judging the merits of the case; however, 
we agree with the opinion and recommendation of the Air Force 
office of primary responsibility and adopt its rationale as the 
basis for our conclusion the applicant has not been the victim of 
an error or injustice. We note the applicant’s records will be 
administratively corrected to reflect award of the BSM, the AFCM, 
and the AFGCM. Therefore, in the absence of sufficient evidence 
the applicant was entitled to award of the JMUA, we find no basis 
to recommend granting his request.

THE BOARD DETERMINES THAT: 

 

The applicant be notified that the evidence presented did not 
demonstrate the existence of a material error or injustice; the 
application was denied without a personal appearance; and the 
application will only be reconsidered upon the submission of 
newly discovered relevant evidence not considered with this 
application.
