APPLICANT REQUESTS THAT: 

 

His date of rank (DOR) to the grade of captain reflect 20 January 
2007 rather than 1 October 2007.

APPLICANT CONTENDS THAT: 

 

His DOR to captain was changed following his mandatory separation 
from active duty due to force shaping. Because he was forced to 
separate by 20 September 2006, his records were reviewed six 
months later which threw off his DOR. 

 

In support of his request, the applicant provides documents 
extracted from his military personnel records. 

 

The applicant’s complete submission, with attachments, is at 
Exhibit A.

STATEMENT OF FACTS: 

 

The applicant is currently serving in the Air Force Reserves 
(AFRes) in the grade of captain. 

 

The remaining relevant facts pertaining to this application, 
extracted from the applicant's military records, are contained in 
the letter prepared by the appropriate office of the Air Force 
(Exhibit B).

AIR FORCE EVALUATION: 

 

ARPC/DPB recommends denial. DPB states the applicant separated 
from active duty on 31 July 2006 and joined the USAFR on 1 August 
2006. The applicant’s name was not submitted with the active 
duty captain promotion list prior to his separation. What he 
believed was his DOR (20 January 2007) was not changed; it never 
existed. He was never selected for promotion while on active 


duty, which is the only avenue from which he could get a January 
2007 DOR. 

 

The FY07 USAFR Captain Promotion Process (V0307A) closed 1 May 
2006 (considered as board adjournment). The applicant was not a 
USAFR asset on board adjournment and therefore could not be 
considered or nominated for USAFR promotion. 

 

The applicant was promoted to the grade of captain on the FY08 
USAFR Captain Promotion Process (V0308A). The board adjournment 
date was 1 May 2007. The soonest possible DOR was 1 October 
2007, the date the applicant received. 

 

DORs and effective dates are established IAW AFI 36-2504, Officer 
Promotion, Continuation and Selective Early Removal in the 
Reserve of the Air Force. The date can be no sooner than the 
date the officer fulfills the required time in grade for 
promotion, the date the approval authority signs the list of 
those recommended for promotion, or public release of the results 
of the selection process, which is later.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 

 

On 12 February 2010, a copy of the Air Force evaluation was 
forwarded to the applicant for review and comment within 30 days 
(Exhibit D). As of this date, this office has received no 
response.

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by existing 
law or regulations. 

 

2. The application was timely filed. 

 

3. Insufficient relevant evidence has been presented to 
demonstrate the existence of an error or injustice. After a 
thorough review of the evidence of record and the applicant’s 
submission, it is our opinion that relief is not warranted in 
this case. The applicant's contentions are duly noted; however, 
other than his own assertions he has provided no evidence which 
sustains his burden of proof of either an error or injustice. 
Therefore, in view of the above and in the absence of evidence to 
the contrary, we find no basis to recommend granting the relief 
sought.

THE BOARD DETERMINES THAT: 

 

The applicant be notified the evidence presented did not 
demonstrate the existence of an error or an injustice; the 
application was denied without a personal appearance; and the 
application will only be reconsidered upon the submission of 
newly discovered relevant evidence not considered with this 
application.
