APPLICANT REQUESTS THAT:

His date of birth (DOB) on his  DD  Form  214,  Report  of  Separation  from
Active Duty, be changed from March 3, 1959, to April 3, 1959.

RESUME OF CASE:

The applicant submitted a similar request dated 3 Jul  08.   On  22 Oct  08,
the Board considered and denied the applicant's request  (Exhibit  G)  based
on the Air Force OPR’s recommendation.

The facts pertaining to the case are as follows:

The applicant was honorably discharged  from  service  on  14  Sep  79.   He
served 2 years,  8  months  and  14  days  on  active  duty.   Documentation
contained in  the  applicant’s  military  service  record,  to  include  his
discharge package, lists his DOB as Mar 3, 1959.

As the applicant’s case was being prepared for litigation in federal  court,
additional facts were brought out not put  before  the  Board  during  their
consideration of  the  case.   Key  among  the  facts  was  the  reason  the
applicant is requesting the correction  of  his  birth  date,  that  it  was
adversely impacting his ability to receive Department  of  Veterans  Affairs
benefits to which he is entitled.  Additionally, the  Air  Force  office  of
primary responsibility (OPR) was contacted and asked to  provide  additional
support of their position to not correct the applicant’s  record.   The  Air
Force OPR upon further review of the applicant’s  case  did  not  provide  a
compelling reason for  the  Board  to  deny  the  requested  relief.   After
discussion with the Air Force  litigators,  it  was  determined  they  would
request a stay to give the Board an additional opportunity to  consider  the
case.

THE BOARD CONCLUDES THAT:

After a thorough consideration of the latest information put  forth  before
the Board in this case, we are persuaded that a change in  the  applicant’s
record is warranted.  Therefore, we recommend that his records be corrected
as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that his date of birth on his DD Form  214
be changed from March 3, 1959 to read April 3, 1959.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that his date of birth on his
DD Form 214 be changed from March 3, 1959 to read April 3, 1959.
