APPLICANT REQUESTS THAT:
His DD Form 214, Armed Forces of the United States Report of Transfer or
Discharge, be corrected to reflect his TDY service in Southeast Asia.

APPLICANT CONTENDS THAT:
In Oct 66, his was TDY to Southeast Asia - Thailand for a little over 60
days.
In support of his request, the applicant provides a personal statement, a
copy of his DD Form 214, a welcome letter and a hotel receipt. The
applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant was honorably released from active duty on 8 Sep 67 and
transferred to the Air Force Reserve for completion of his military service
obligation which occurred on 10 Sep 69. The applicant was credited with 3
years, 11 months and 28 days of active service. No foreign service was
noted. His DD Form 214, reflects he was awarded the National Defense
Service Medal, Air Force Good Conduct Medal and the Small Arms Expert
Marksmanship Ribbon.

AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial. DPAPP states that based on the lack of
documents confirming the applicant's Vietnam service, they must recommend
denial of his request. DPAPP reviewed the applicant's supporting
documentation; however, it is not sufficient to verify foreign service.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 13 Jun
08 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. Applicant’s contentions are duly noted;
however, we do not find these assertions, in and by themselves,
sufficiently persuasive to override the rationale provided by the Air
Force. While the possibility exists that the applicant was TDY to
Southeast Asia, he has provided no official documentation to substantiate
he was there for any specific dates or length of time. Absent such
evidence, we must agree with the recommendation of the Air Force and adopt
the rationale expressed as the basis for our decision that the applicant
has failed to sustain his burden of proof that either an error or an
injustice has occurred. Therefore, we find no basis to recommend granting
the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our decision that the applicant has failed to sustain his burden of proof of the existence of either an error or an injustice. Credit for service in Vietnam requires a member to have served (on ground or landed at least one day) in Vietnam.

However, after a thorough review of the applicant’s submission and the available evidence of record, we are not persuaded that he should be awarded the VSM.
