APPLICANT REQUESTS THAT:
His records be corrected to reflect award of the Armed Forces
Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:
He was assigned to the 83rd Fighter Interceptor Squadron (83rd FIS) at
Hamilton Air Force Base (AFB). From Sep 58 to Dec 58, he was deployed
to Tao Yuan Air Base (AB) in Taiwan during the Quemoy-Matsu Crisis.
This was a Nationalist Chinese combat base that flew combat air
patrols daily, with the F-104A’s flying cover. He was definitely in a
combat zone. He has been told that several members of the squadron
have received the AFEM for this mission, and he believes he should
also be awarded the medal.
In support of his appeal, the applicant provides copies of his
separation document, his temporary duty (TDY) orders, and other
documentation pertaining to the matter under review.

STATEMENT OF FACTS:
Applicant’s available military personnel records indicate he enlisted
in the Regular Air Force on 23 Aug 56 for a period of four years in
the grade of airman basic.
By Special Orders B-97, dated 6 Sep 58, while assigned to the 83rd
FIS, he was deployed to a classified destination for an indefinite
period of TDY.
Applicant was honorably discharged on 22 Aug 60 under the provisions
of AFR 39-10 (Expiration Term of Service) in the grade of airman
second class. He was credited with four years of active service.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial noting the AFEM is awarded to military
personnel for operations approved by the Department of Defense or the
Joint Staff. To confirm entitlement of the AFEM, the applicant must
provide a source document (travel voucher, TDY orders, etc.) to verify
he participated in an approved operation approved for the award of the
AFEM. The AFEM was awarded to those who were assigned to the island
of Quemoy and Matsu from 23 Aug 56 to 1 Jun 63. After a thorough
review of the applicant's military record they were unable to locate
documents to verify applicant was on the Island of Quemoy-Matsu and
applicant did not provide documentation to substantiate he was in the
area of eligibility.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 11
Apr 08 for review and response within 30 days. As of this date, no
response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we are not persuaded that corrective action is warranted.
The applicant has not presented evidence which shows to our
satisfaction that he met the established criteria for award of the
AFEM. In view of the foregoing, and in the absence of evidence to the
contrary, we agree with the recommendation of the OPR and conclude the
applicant has failed to sustain his burden of establishing the
existence of either an error or
injustice. Accordingly, we find no compelling basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
