APPLICANT REQUESTS THAT:

His TDY from Jul 03 to Sep 03 be included on  his  Officer  Selection  Brief
(OSB) for  the  CY07B  (27  Nov  07)  (P0507B)  Lieutenant  Colonel  Central
Selection  Board  (CSB)  and   he   be   given   Special   Selection   Board
consideration.

APPLICANT CONTENDS THAT:

He discussed his records with senior leadership and was advised the  missing
deployment  information  could  have  swayed  the  board  in  favor  of  his
promotion selection.  During  wartime,  increased  emphasis  is  put  on  an
officer’s commitment and service  by  completing  either  a  staff  tour  or
direct involvement on the battlefield.  The missing information  could  have
made the difference to the board  and  affected  his  promotion  because  it
highlighted his experience in the combat arena.

In support of the application, the applicant submits his  Hostile  Fire  Pay
history, his temporary duty (TDY) assignment history,  and  his  case  input
form.

STATEMENT OF FACTS:

Information extracted from  the  Military  Personnel  Data  System  (MilPDS)
indicates the applicant is a major with a date of rank of 1 Feb 04.   He  is
currently assigned as a Commander.  He has one non-selection  to  the  grade
of lieutenant colonel.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit b.

AIR FORCE EVALUATION:

HQ AFPC/DPSOO recommends denial.  DPSOO states  information  extracted  from
MilPDS indicates his actual TDY dates as 30 Jul 03 through  5  Sep  03  –  a
total of 38 days.

Only type 1 Contingency/Rotational or Type  2  Exercise  Deployments  of  45
days or more will be displayed in the  deployment  history  section  of  the
OSB.  Applicant’s TDY does not meet requirements to be reflected on the  OSB
for the promotion selection process.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 18  Jul
08 for review and comment within 30 days.  As of this date, this office  has
received no response (Exhibit C).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  Therefore, we agree with the  opinion  and
recommendation of the Air Force office of primary responsibility  and  adopt
its rationale as the basis for our conclusion that  the  applicant  has  not
been the victim of an error or injustice.  Based on the foregoing,  we  find
no basis to recommend granting the relief sought in this application.
