Under the authority of Section 1552, Title 10, United States Code,
Air Force Instruction 36-2603, and having assured compliance with the

section to reflect "35. Diminished or reduced range of motion, some
residual deformity, and some level of secondary weakness, or ineffective

weakness, deformity, or loss of motion, left second finger."

He has back pain 90% of the time, averaging a 4/10, but flare-ups occur twice monthly and last 4 to 5 days at an 8/10 pain. Although the NARSUM raised the question of a motor weakness, this was more likely an artifact of pain and guarding; since all formal strength testing in evidence was normal. I concur with that finding, accept their recommendation and direct that your records be corrected as set forth in the attached copy of a Memorandum for the Chief of Staff, United States Air Force.

The PEB adjudicated “s/p left ankle bimalleolar fracture” as unfitting, rated 10% with application of the Veterans Affairs Schedule for Rating Disabilities (VASRD). I believe that the Decision Board didn't take in consideration all the medical evidence in my favor thus making an erroneous decision; in this case: "when the disability was likely to have occurred or was aggravated, rather than make the assumption it occurred when the claim was originally filed, in addition this is a "faulty...

The medical basis for the separation was Myofascial Pain Syndrome w/Mid and Upper Back Pain. The Board also considered the condition of Left Shoulder Strain and unanimously determined this condition was not separately unfitting at the time of separation from service and therefore no disability rating is applied. The pertinent military records of the Department of the Air Force relating xxxxxxxxxxxxxx, be corrected to show that the diagnosis in her finding of unfitness was myofascial pain...

Left Wrist Condition. The Board therefore has no reasonable basis for recommending any additional unfitting conditions for separation rating. In the matter of the right knee pain, right ankle pain, and left knee pain conditions or any other medical conditions eligible for Board consideration, the Board unanimously agrees that it cannot recommend any findings of unfit for additional rating at separation.

In the majority of the records in evidence, the sensory and motor examinations were normal as was gait, similar to the MEB examination. The CI had a herniated disc with radicular pain which was treated with surgery, and there were symptoms of radiating pain documented in the treatment records. Left calf atrophy was noted on examinations, and measurement at the C&P examination indicated mild atrophy, however normal strength was noted in the majority of examinations.
