APPLICANT REQUESTS THAT:

His records be corrected to reflect award  of  the  Army  Commendation
Medal (ACM).

APPLICANT CONTENDS THAT:

The medal was omitted from his records.

In support of his request, applicant provided documentation associated
with the ACM recommendation.

His complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Air Force on 5 Jan 65 as an airman basic
for a period of four years.  He was  honorably  released  from  active
duty on 18 Oct 68.

AIR FORCE EVALUATION:

HQ AFPC/DPSIDR recommends the request for award of the ACM be  denied.
DPSIDR states no official documentation was  located  in  his  records
that verify the ACM was processed or approved by higher  headquarters.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
25 Jan 08, for review and response within 30 days.  As of  this  date,
no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice.  After thoroughly reviewing
the military personnel records  and  documentation  submitted  by  the
applicant, we found no evidence to verify the recommendation  for  the
award of the ACM  was  approved  by  the  award  approving  authority.
Therefore, we agree with the opinion and  recommendation  of  the  Air
Force office of primary responsibility and adopt its rationale as  the
basis for our decision that the applicant has failed  to  sustain  his
burden of proof of the existence of either an error or  an  injustice.
In the absence of evidence to the  contrary,  we  find  no  compelling
basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
