APPLICANT REQUESTS THAT:

His DD  Form  214  be  updated  to  reflect  the  Global  War  on  Terrorism
Expeditionary Medal (GWOT-E), the Air  Force  Expeditionary  Service  Ribbon
with Gold Border (AFESR w/GB), the Global War  on  Terrorism  Service  Medal
(GWOT-S), and the Meritorious Unit Award (MUA).

APPLICANT CONTENDS THAT:

His unit of  assignment  received  the  medals  listed  above  for  services
performed in  support  of  Operation  IRAQI  FREEDOM  during  their  6-month
deployment.

In support of his request, the applicant provided a  personal  statement,  a
copy of an Air Force Achievement Medal certificate and order, and a copy  of
his DD Form 214.

Her complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant served on active duty for 2 years, 6 months,  and      9  days
and was honorably discharged on 18 October 2004.

AIR FORCE EVALUATION:

AFPC/DPSIDR recommends denial of his request for  the  MUA.   DPSIDR  states
that they were unable to verify that his unit of  assignment  ever  received
the MUA during the period in question.  However, they were  able  to  verify
the applicant's entitlement to the GWOT-E, the AFESR w/GB, and the GWOT-S.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded  to  the  applicant  on  24
October 2008 for review and comment within 30 days.  As of this  date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice warranting award of the MUA.  Based  on  the
evidence provided, we are unable  to  corroborate  his  entitlement  to  the
award of the MUA, as  he  is  contending.   Therefore,  we  agree  with  the
opinion  and  recommendation  of   the   Air   Force   office   of   primary
responsibility and adopt its rationale as the basis for our conclusion  that
other than what has been administratively corrected, the applicant  has  not
been the victim of an error or injustice.   Therefore,  in  the  absence  of
evidence to the contrary, we find no compelling basis to recommend  granting
the additional relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
