He be given credit for his service in Vietnam.

APPLICANT CONTENDS THAT:

He was in Vietnam in a secret capacity and now needs to prove  this  due  to
his disabilities.

Applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:

On 3 August 1971, applicant enlisted in the Regular Air  Force.   He  served
as an Administrative Helper.

On 12 January 1973, applicant was  honorably  discharged  in  the  grade  of
airman first class.  He served 1 year, 5 months and 10 days on active duty.

Applicant’s DD Form 214,  Armed  Forces  of  the  United  States  Report  of
Transfer or Discharge, item 30, reflects “Vietnam - No.”

On 13 December 2007, AFPC/DPAPP, advised the applicant  that  there  was  no
documentation in his Military Personnel Record (MPR) that confirms  any  TDY
or flights or mission into Vietnam.  His record shows he  spent  a  complete
tour of duty in the Air Force at Mountain  Home  AFB,  Idaho.   DPAPP  asked
that he provide documentation which  verifies  his  Vietnam  service  (i.e.,
travel vouchers, flight records or TDY orders that show a specific time  and
location in Vietnam.)

AIR FORCE EVALUATION:

AFPC/DPAPP recommends denial.  DPAPP states no documentation could be  found
within the applicant’s MPR that verifies he served at any time  in  Vietnam.
DPAPP asked the applicant to check his personal files to  see  if  he  might
have any documentation that  substantiate  his  claim  to  Vietnam  service;
however, he did not respond.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 8 February 2008, the  evaluation  was  forwarded  to  the  applicant  for
review and comment within 30 days  (Exhibit  D).   As  of  this  date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an error or an  injustice.   The  applicant’s  contentions  are
duly noted; however, after reviewing the evidence of record  we  agree  with
the  opinion  and  recommendation  of  the  Air  Force  office  of   primary
responsibility and adopt its rationale as the basis for our conclusion  that
the applicant has not been the victim of an error or injustice.   Therefore,
in the absence of evidence to the contrary, we find no compelling  basis  to
recommend granting the relief sought.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented  did  not  demonstrate  the
existence of an error or injustice; the application  was  denied  without  a
personal appearance; and the application will only be reconsidered upon  the
submission of newly discovered relevant evidence not  considered  with  this
application.
