                       RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2005-03870
            INDEX CODE: 100.00

            COUNSEL: NONE

            HEARING DESIRED: NO

MANDATORY CASE COMPLETION DATE: 23 June 2007

_________________________________________________________________

APPLICANT REQUESTS THAT:

His records be corrected to reflect credit for TDY service in Vietnam
during the period of November 1961 to February 1962.

_________________________________________________________________

APPLICANT CONTENDS THAT:

His assignment was classified secret or top secret at the time of
service. He was not allowed to keep any record of the assignment.

The applicant does not provide any documents in support of the appeal.

Applicant's complete submission is at Exhibit A.

_________________________________________________________________

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force on 14 August 1958 for
a period of four years. He was promoted to the grade of airman second
class on 1 June 1961. He was released from active duty for the
convenience of government on 30 April 1962, and was discharged from
the Air Force Reserve effective 13 August 1964.

_________________________________________________________________

AIR FORCE EVALUATION:

AFPC/DPAPP states there are no documents in the applicant’s Master
Personnel Record that show any TDY into Vietnam. He was asked to
review his personal files to see if he could find any documents they
could use to verify any time spent in Vietnam. He apparently does not
have any documentation because he did not respond to their request.
Therefore, they recommend denial of applicant’s request.

A complete copy of the evaluation is at Exhibit C.

_________________________________________________________________

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant provided a statement dated 15 March 2006, with two
photos attached.

Applicant's response, with attachments, is at Exhibit E.

_________________________________________________________________

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.

3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt its rationale as the basis
for the conclusion that the applicant has not been the victim of an
error or injustice. We note, the applicant was asked to review his
personal files to see if he could find any documents that could be
used to verify any time spent in Vietnam; however, he did not respond.
Therefore, in the absence of evidence to the contrary, we find no
basis to recommend granting the relief sought in this application.

_________________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

He served in Vietnam from 1971 to 1972; and the Persian Gulf in 1991. He served during the Vietnam War while assigned to the states, and he would only be sent to Vietnam for 89 days at a time so no records would list him as being TDY or permanent party in Vietnam. He provided evidence reflecting service connected disability from the DVA; however, based on the evidence of record and that submitted by the applicant, there is no evidence to substantiate that the applicant was ever TDY or...
