APPLICANT CONTENDS THAT:
His time of temporary duty in Vietnam is not shown on his record.
In support of the appeal, applicant submits a copy of his DD Form 214.

STATEMENT OF FACTS:
Applicant entered the Regular Air Force on 18 April 1967 for a period
of four years. He was honorably released from active duty on 17
January 1972, having served four years and nine months on active duty,
of which two years and one month were foreign/SEA (Southeast Asia)
service. His AF Form 7, Airman Military Record, shows he was TDY in
SEA from 8 May 1970 to 15 June 1970 (39 days). The following
decorations are reflected on his DD Form 214: The National Defense
Service Medal, the Air Force Good Conduct Medal, and the Air Force
Longevity Service Award.
There are no documents in applicant’s Master Personnel Records that
confirm any TDY to Vietnam. Applicant was asked to check his personal
files for any documents he might have to confirm a TDY into Vietnam.
He did not respond to the request.

AIR FORCE EVALUATION:
AFPC/DPAPP recommends the application be denied. There are no source
documents confirming any TDY into Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 24 June 2005, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice. We note
the applicant was asked to check his personal files for any documents
he might have to confirm a TDY into Vietnam; however, he did not
respond. Therefore, in the absence of such evidence, we find no basis
to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
