APPLICANT REQUESTS THAT:

His reentry (RE) code “2K” (Has been formally  notified  by  the  unit
commander of initiation of involuntary separation action)  be  changed
to a "1."

APPLICANT CONTENDS THAT:

He  does  not  have  a  personality  disorder  and  has   never   been
hospitalized with psychiatric treatments.

In support of his appeal, applicant submitted a copy of his  DD  Form
214, Certificate of Release or Discharge from Active Duty, a personal
statement and a letter from his physician.

Applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force on  4 Mar  98,  as  an
airman basic for a period of four years.

On 20 Nov 98, he was notified that his commander was recommending  his
discharge from the Air Force for  a  mental  disorder.   The  specific
reason for the discharge action was:

      On 2 and 9 Nov 98, he was evaluated by  Mental  Health  Services
and was diagnosed with Adjustment Disorder with Mixed  disturbance  of
Emotions and Conduct, Personality  Disorder  Not  Otherwise  Specified
(Antisocial Traits).

In the notification for discharge, the commander cited  the  following
derogatory information:

      On 13 Sep 98, he received a Letter of Counseling for being  late
for guardmount.

      On 23 Sep 98, he received a Letter of Reprimand for  being  late
for guardmount.

His commander advised him of his rights in this matter.

On 20 Nov 98, he acknowledged receipt of the notification  and  after
consulting with counsel waived his right to submit statements in  his
own behalf.

On 1 Dec 98, the legal office reviewed the case and found  it  legally
sufficient to support discharge  and  recommended  discharge  with  an
honorable discharge without probation and rehabilitation.

On 2 Dec 98, the  discharge  authority  approved  the  discharge  and
directed discharge with an honorable discharge without probation  and
rehabilitation.

He was discharged on 4 Dec 98.  He  served  eight  months  on  active
duty.

AIR FORCE EVALUATION:

The AFBCMR Medical Consultant recommends denying the request for an RE
code change; however, he  does  recommend  the  narrative  reason  for
discharge be changed to Adjustment Disorder.  The  Medical  Consultant
acknowledges the  comparative  negative  stigma  associated  with  the
diagnosis of a Personality Disorder and the possible impediment to the
applicant' future educational and occupational  pursuits.   Therefore,
despite  his  underlying  maladaptive  personality  style,  Adjustment
Disorder is a more appropriate reason for  his  discharge.   Utilizing
this alternative to depict the reason for his  discharge  will  likely
have a less adverse impact on his  future  educational  or  occupation
pursuits.

Although, he was reevaluated by his physician and appears to be  doing
well at this time, it does not predict he will  respond  well  to  the
stresses of a military environment.   He  remains  vulnerable  for  an
unexpected  acute  exacerbation   of   his   previously   demonstrated
underlying maladaptive  pattern  of  behavior,  therefore,  posing  an
unreasonable risk to his health and well-being.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant
on 7 Mar 08, for review and response within 30 days.  As of this date,
no response has been received by this office.

ADDITIONAL AIR FORCE EVALUATION:

AFPC/DPSOA recommends the request to change the reentry code to a  "1"
be denied.  However, DPSOA recommends his  reentry  code  of  "2K"  be
corrected  to  a  "2C,  involuntarily  separated  with  an   honorable
discharge,  or  entry-level  separation  without  characterization  of
service" to more accurately reflect his discharge.

APPLICANT'S REVIEW OF ADDITIONAL AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
31 Mar 08, for review and response within 30 days.  As of  this  date,
no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.     Insufficient  relevant  evidence   has   been   presented   to
demonstrate the existence of an error or an injustice warranting  the
requested relief.  The applicant is requesting his  reentry  code  be
changed to a "1" series reentry code which would allow his  immediate
reenlistment in the Air Force.  After a review  of  the  evidence  of
record, we find no basis to grant the requested relief.  We note that
the Air Force office of primary responsibility has indicated that the
current  reentry  code   is   incorrect   and   will   be   corrected
administratively.  Accordingly, in the absence  of  evidence  to  the
contrary, we find no compelling basis to recommend further change  in
his reentry code.

4.    Notwithstanding the above, the AFBCMR  Medical  Consultant  has
provided an evaluation in which he states that the  narrative  reason
for  the  applicant's  discharge,  Personality  Disorder,  does   not
accurately reflect the circumstances of his separation.  We
agree with assessment  that,  Adjustment  Disorder,  more  accurately
reflects the circumstances surrounding his  discharge  and  recommend
his records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that he was discharged  on
4 December 1998 with a narrative reason for separation of  "Adjustment
Disorder" rather than "Personality Disorder", and a separation code of
"JFY" rather than "JFX".

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116) it is directed that:

      The pertinent military records of  the  Department  of  the  Air
Force relating to  ,   be corrected to show that he was discharged  on
4 December 1998 with a narrative reason for separation of  "Adjustment
Disorder" rather than "Personality Disorder", and a separation code of
"JFY" rather than "JFX".
