APPLICANT REQUESTS THAT:
1. Corrections be made to his Officer Selection Brief (OSB) and the
discrepancy report be removed from his records.
2. He receive Special Selection Board (SSB) consideration by the
Calendar Year 2006 (CY06C) Below-the-Promotion Zone (BPZ) Lieutenant
Colonel Central Selection Board (CSB).

APPLICANT CONTENDS THAT:
His as-met records contained a memorandum stating his Joint Service
Achievement Medal (JSAM) with one Oak Leaf Cluster (OLC) was missing.
The memorandum is incorrect because he was never awarded a second
JSAM. He researched the problem and was informed by AFPC that the Air
Force Automated Records Management System showed source documents for
one Air Force Achievement Medal (AFAM) and one JSAM, but the Military
Personnel Data System (MilPDS) indicated updates for one AFAM and two
JSAMs. He believes the AFAM awarded for the period 24 Mar 99 through
9 Apr 99 was erroneously updated as the second JSAM.
In support of his application, the applicant provided a memorandum,
his pre-board and as-met records, and e-mail communiqué.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of
major.
The applicant was considered and not selected for promotion to the
grade of lieutenant colonel by the CY06C BPZ CSB.

AIR FORCE EVALUATION:
AFPC/DPSOO recommends the applicant’s request for promotion
consideration by an SSB be denied. DPSOO states the applicant did not
exercise reasonable diligence in ensuring his OSB was accurate prior
to the convening of the board. The applicant reviewed his OSR prior
to the convening of the promotion board, but does not mention he
reviewed his Officer Preselection Brief (OPB). Each eligible officer
for promotion is provided an OPB several months prior to the convening
of the selection board. The OPB contains information that will appear
on the OSB at the CSB. The OPB with written instructions are given to
the officer before the CSB informing the officer to carefully examine
the brief for completeness and accuracy. If any errors are found,
they must take corrective action before the selection board not after
it.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 19 Oct 07, a copy of the Air Force evaluation was forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. After thoroughly reviewing
the evidence of record, we are not persuaded that the applicant should
be provided consideration for promotion to the grade of lieutenant
colonel by a Special Selection Board for the Calendar Year 2006C
selection board. Service members who are eligible to meet a promotion
board are instructed to request a copy of their OSR to ensure their
records are complete and accurate. The applicant states he reviewed
his OSR but did not mention if he reviewed his OPB prior to the
convening of the Board. We find no evidence that he exercised due
diligence to ensure the data in his records was accurate for
presentation to the board. We are not persuaded by the evidence
before us that the discrepancy report was the sole cause for the
applicant’s non-selection to the grade of lieutenant colonel.
Therefore, we agree with the recommendation of the Air Force office of
primary responsibility and adopt the rationale expressed as the basis
for our conclusion that the applicant failed to sustain his burden of
establishing the existence of either an error or an injustice
warranting favorable action on his request.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
