APPLICANT REQUESTS THAT:

The following corrections be made  to  his  Officer  Selection  Brief  (OSB)
reviewed by the CY07B Lieutenant Colonel Central Selection Board:

      a.  Change duty title “ADO  SAFETY/F-16  1P”  to  read  “CHIEF  OF  SQ
SAFETY/F-16 IP.”

      b.  Include an Air Force Achievement Medal (AFAM) under decorations.

      c.  Include attendance at  George  C.  Marshall  School  for  European
Security Studies.

He also requests he be given Special  Selection  Board  (SSB)  consideration
after his OSB has been corrected.

APPLICANT CONTENDS THAT:

On at least six separate occasions, he attempted to correct his  records  as
indicated above.  The missing and inaccurate information shows what  caliber
of officer he is and indicates the  level  of  responsibility  entrusted  to
him.  The absence of this significant information detracts  from  his  image
and character with the promotion board.

In support of the application, he submits a memorandum and  electronic  mail
message from the military personnel flight commander, his Data  Verification
Brief (DVB), and  electronic  mail  message  regarding  George  C.  Marshall
European Center for Security Studies.

The applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Information extracted from  the  Military  Personnel  Data  System  (MilPDS)
indicates the applicant is a major with a date of rank of 1 Oct 03.  He  has
one non-selection to the grade of lieutenant colonel.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibits B, C and D.

AIR FORCE EVALUATION:

HQ  AFPC/DPAO  recommends  granting  the   applicant’s   request   for   SSB
consideration due to the duty title discrepancy on his OSB.

The complete DPAO evaluation is at Exhibit B.

HQ AFPC/DPAPFE recommends denial of his request  to  include  attendance  at
the George C. Marshall School for European Security Studies.  DPAPFE  states
there is  no  documentation  in  the  applicant’s  records  to  reflect  his
attendance at GCMC.  If he attended the school, he  did  not  attend  it  as
part  of  an  Intermediate   Developmental   Education   (IDE)   or   Senior
Developmental Education (SDE) program.  Currently the Air Force  only  sends
lieutenant colonels or above to the George C.  Marshall  School  as  an  SDE
program.

The complete DPAPFE evaluation is at Exhibit C.

HQ  AFPC/DPSOO  recommends  denial  of  the  applicant’s  request  for   SSB
consideration.  DPSOO states eligible officers are provided with an  Officer
Preselection Brief (OPB) several months prior to the selection  board.   The
OPB mirrors the data that will appear on  the  OSB  at  the  central  board.
Corrections must be made prior to the board convening.

DPSOO concurs with DPAPFE’s assessment  of  the  applicant’s  attendance  at
George C. Marshall School.  His Officer Performance  Report  (OPR)  rendered
for the period of 19 Jun 04 through 23 Oct 04 captured his  graduation  from
the George C. Marshall School.  Apparently, he attended the school  under  a
program other than  IDE;  therefore,  it  was  not  reflected  on  his  OSB.
However, eligible officers have the option to submit a letter to  the  board
president addressing any matter of  importance  concerning  their  promotion
consideration; thus, he could have written a letter to the board  explaining
his attendance at the George C. Marshall program.

Although his AFAM was not reflected on his OSB, the citation  was  filed  in
his OSR on 9 Nov 07 and was  available  to  the  board  members  during  the
promotion selection process.  Therefore, correcting his OSB to  include  the
AFAM would not introduce any new information not already considered  by  the
board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 24  Oct
08 for review and comment within 30 days.  As of this date, this office  has
received no response (Exhibit E).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence  of  error  or  injustice.    After   thoroughly   reviewing   the
applicant's submission along with the evidence of record, it is our  opinion
that some corrective action is warranted in this case.  We believe that  the
applicant made a diligent effort to ensure his selection record was  correct
prior to  the  convening  of  the  selection  board.   While  it  cannot  be
conclusively determined what impact the omission of the award  citation  and
incorrect duty title may have had on his promotion opportunity,  we  believe
any doubt should be resolved in his favor and that the  final  determination
should be appropriately placed in the hands of a duly constituted SSB.

4.  Insufficient relevant evident has  been  presented  to  demonstrate  the
existence of error or injustice in regards to  the  applicant’s  request  to
include his attendance  at  the  George  C.  Marshall  School  for  European
Security   Studies.    Therefore,   we   agree   with   the   opinions   and
recommendations of the offices of primary  responsibility  and  adopt  their
rationale as the basis for our conclusion that the applicant  has  not  been
the victim of an error  or  injustice.   Therefore,  we  conclude  that  his
records should only be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT, be corrected by amending the Officer Selection Brief  prepared
for the Calendar Year 2007B Lieutenant Colonel Central  Selection  Board  as
follows:

      a.  Under decorations, include the award of the Air Force  Achievement
Medal (AFCM), 9 Jun 2007.

      b.  Change the duty title of “ADO SAFETY/F-16  IP”  to  “CHIEF  OF  SQ
SAFTEY/F-16 IP,” effective 8 Nov 07.

It is further directed that his record, to include  the  above  corrections,
be considered for promotion to the grade of Colonel by a  Special  Selection
Board (SSB) for the CY07B Lieutenant Colonel Central Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected by amending the Officer Selection
Brief prepared for the Calendar Year 2007B Lieutenant Colonel Central
Selection Board as follows:

      a.  Under decorations, include the award of the Air Force
Achievement Medal (AFCM), 9 Jun 2007.

      b.  Change the duty title of “ADO SAFETY/F-16 IP” to “CHIEF OF SQ
SAFTEY/F-16 IP,” effective 8 Nov 07.

      It is further directed that his record, to include the above
corrections, be considered for promotion to the grade of colonel by a
Special Selection Board (SSB) for the CY07B Central Lieutenant Colonel
