APPLICANT REQUESTS THAT:

His under other than honorable conditions (UOTHC) discharge be upgraded  to
a general discharge.

STATEMENT OF FACTS:

On 15 May 2008, the Board considered and denied a similar appeal.   For  an
accounting of the facts surrounding his previous request and the  rationale
of the Board's earlier decision, see the Record of Proceedings  at  Exhibit
E.

In his appeal for reconsideration, applicant provides a statement  in  which
he discusses the events as they transpired during  his  period  of  service.
In support of his appeal he  provided  character  reference  statements  and
certificates of training.

His complete submission, with attachments, is at Exhibit F.

THE BOARD CONCLUDES THAT:

In earlier findings, we determined that there was insufficient  evidence  to
warrant  an  upgrade  of   the   applicant’s   discharge.    After   careful
reconsideration of his request and his most recent  submission,  we  do  not
find it sufficiently  compelling  to  warrant  a  revision  of  our  earlier
determination in his case.  Contrary  to  the  applicant’s  assertions,  his
military personnel records clearly show he was discharged for failure to  go
and being absent without leave for three  weeks.   It  remains  our  opinion
that the discharge proceedings were proper and the characterization  of  the
discharge was appropriate to the circumstances.  Although the applicant  has
provided documentation pertaining to his post-service  activities,  we  find
these insufficient to warrant an upgrade of his discharge on  the  basis  of
clemency.  Therefore, we find no compelling basis to act  favorably  on  his
request for an upgrade of his discharge.

RECOMMENDATION OF THE BOARD:

The applicant be notified that the evidence presented did not  demonstrate
the existence of error or  injustice;  that  the  application  was  denied
without a personal appearance; and  that  the  application  will  only  be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
