APPLICANT REQUESTS THAT:
His DD Form 214 be corrected to reflect entitlement to the Presidential
Unit Citation (PUC).

APPLICANT CONTENDS THAT:
As a member of the 18th Avionics Maintenance Squadron (AMS) from December
1971 to June 1973, he was eligible for the PUC.
He was originally sent to PACAF on 20 December 1971, and assigned to the
18th Tactical Fighter Wing (TFW), 18th AMS, Kadena AB, Okinawa. During his
time with the 18th AMS, he was part of a group that was sent to Kunsan,
Korea, on 2 April 1972, when the Vietnamese attacked the bases in South
Vietnam and a detachment of aircraft were sent to Da Nang AB. After
spending 45 days in Kunsan, he returned to Kadena and, 45 days later, was
sent TDY to Korat, Thailand, in support of the same aircraft, and he stayed
with them until they returned to Kunsan. During that time, there were a
group of F-4C Wild Weasels sent to Korat to support them, and he stayed at
Korat to support them. During this time, they earned the PUC which he
believes he is entitled to.
In support of his application, he has provided copies of his DD Form 214,
dated 3 January 2004, and a personal statement, dated 15 January 2007.

STATEMENT OF FACTS:
Applicant served on active duty from 20 October 1970 to 3 January 1974. He
reenlisted on 4 January 1974, and served until his discharge in the grade
of sergeant (E-4) on 24 December 1977. At the time of his discharge, he
was serving as a weapon control systems mechanic, and was credited with a
total of three years, one month, and 25 days of Foreign and/or SEA Service.
During his service from 20 October 1970 to 3 January 1974, his records
contain three Airman Performance Reports while he was assigned to the 18th
AMS, Kadena AB, Okinawa, and the 432nd AMS, Udorn RTAFB, Thailand. His DD
Form 214s reflect entitlement to the National Defense Service Medal, Air
Force Longevity Service Award, and Air Force Good Conduct Medal with one
Oak Leaf Cluster.
His application has been partially resolved administratively. On 24 June
2004, AFPC corrected item 15 of his DD Form 214, dated 3 January 2004, to
reflect a Date Entered Active Duty of 20 October 1970. On 9 February 2007,
AFPC further corrected the same DD Form 214 to correct item 18f to show two
years, zero months, and 14 days of Foreign and/or SAE Service.
DoD 1348-33-M, AP2.1.2.1, states the PUC is awarded in the name of the
President of the United States to units of the Armed Forces of the United
States, and co-belligerent nations, for extraordinary heroism in action
against an armed enemy, occurring on or after 7 December 1941. The unit
must have displayed such gallantry, determination, and esprit de corps in
accomplishing its mission, under extremely difficult and hazardous
conditions, to have set it apart and above other units participating in the
same campaign. The degree of heroism required is the same as that which
would be required for award of a Distinguished Service Cross to an
individual.
AFI 36-2803, Table 2.1 states the Air Force Cross is awarded to individuals
engaged in an action against an enemy of the United States, or while
engaged in military operations involving conflict with an opposing foreign
force, or while serving with friendly foreign forces engaged in an armed
conflict against an opposing force in which the United States in not a
belligerent party. It is awarded for extraordinary heroism, not justifying
the Medal of Honor.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial without official documentation to verify his
entitlement to the PUC. After completely researching AFP 900-2, Volumes I,
II, and III, they were unable to verify that the 18th TFW, 18th AMS, or
432nd AMS received the PUC during the time applicant was assigned to the
units. Applicant needs to provide official documentation to verify his
unit(s) received the PUC during the time he was assigned to the units.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the evaluation was forwarded to the applicant on 9 March
2007, for review and comment, within 30 days. However, as of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. There is
no evidence that the 18th TFW, 18th AMS, or 432nd AMS received the PUC
during the time applicant was assigned to these units. Therefore, in the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
