APPLICANT REQUESTS THAT:

He receive supplemental consideration for promotion to colonel.

APPLICANT CONTENDS THAT:

His records were missing his Distinguished Flying Cross (DFC),  Bronze  Star
(BS)  and  several  Air  Medals  (AMs)  at  the  time   of   his   promotion
consideration to colonel.

He was also told by the Office of Personnel at  Randolph  that  his  records
indicated he spent an entire  year  in  Vietnam  and  did  not  receive  any
medals.

In support of his application, applicant submits copies of  orders  for  the
DFC, BS, AMs, Officer Effective Reports and letters of accomplishments.

Applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

On 18 November 1944, the applicant accepted a commission in the Army of  the
United States (AUS) as a second lieutenant (2Lt).

The applicant met and was  nonselected  by  the  Temporary  Colonel  Boards:
Fiscal Year 1970 (FY 70), Calendar Year 1971 (CY 71), FY 72, CY 73,  FY  74,
FY 75A, and FY 75B.

The applicant retired on 1 January 1975 with 26 years, 10 months and 2  days
of active service for retirement.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the requested relief  be  denied.   AFPC/DPPPO  states
the decorations the applicant alleges were  missing  from  his  records  are
filed in his official personnel records.  The applicant’s DFC  and  BS  were
approved prior to the FY 70 board, and no evidence was  found  to  show  the
decorations were missing at the time he  was  considered  for  promotion  to
colonel.  They further note the reverse side of the  DFC  citation  is  date
stamped 1 July 1968, which at that time reflected the date the citation  was
filed into the officer selection record.  The  applicant  has  not  provided
any documentation to show that the  citations  were  not  on  file  for  his
promotion boards to colonel.  The applicant’s AM w/4 OLCs was  not  approved
until 8 December 1970 and therefore would not have been on file at the  time
of his in the promotion zone (IPZ) or his first  above  the  promotion  zone
(APZ) board.  Furthermore,  there  no  evidence  to  substantiate  that  the
citations were missing from the applicant’s subsequent boards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant reviewed the Air Force  evaluation  and  states  he  does  not
believe there is a time restraint for applying for  Correction  of  Military
Records.  He further states  it  is  standard  administrative  procedure  to
stamp the date the document was  received,  not  the  date  it  was  posted.
Further, there was no mention of the date posted for the BS or AMs 1, 2,  3,
only AM 4.  Nor was there any mention of the 211  Combat  Missions  and  517
Flying House in Southeast Asia or the 77 Combat Support Missions  and  204.8
combat support flying hours.

Also, there was no mention of his two  MSMs  or  his  Officer  Effectiveness
Reports endorsements and letters of accomplishments.

He further stated he can not provide evidence of a  telephone  conversation.
He will be  happy  to  take  a  lie  detector  test  to  prove  a  telephone
conversation he had with a major in the Office of Personnel (Exhibit E).

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was not timely filed; however, it is in  the  interest
of justice to waive the failure to timely file.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or an injustice.   Applicant’s  contentions  are  duly
noted; however, we agree with the opinion  and  recommendation  of  the  Air
Force and adopt its rationale as the  basis  for  our  conclusion  that  the
applicant has not been  the  victim  of  an  error  or  an  injustice.   The
citations and decorations  the  applicant  alleges  were  missing  from  his
records are on file in his official personnel records.   The  applicant  has
not provided any evidence to substantiate that the decorations  in  question
were not in his records at time he met the colonel’s boards.  Therefore,  in
the absence of evidence to the contrary, we  find  no  compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
