APPLICANT REQUESTS THAT:

His  Reenlistment  Eligibility  (RE)  code  be  changed   from   “2C,”
“Involuntarily separated with an honorable discharge; or  entry  level
separation without characterization of  service,”  to  one  that  will
allow his reentry into the US military.

RESUME OF CASE:

On 17 Nov 04, the Board considered and denied the applicant’s  request
as stated above (Exhibit E).  In a DD Form 149, dated    5 Aug 06, the
applicant again requests his RE code be changed to one that will allow
him to reenlist in the Navy (Exhibit F).  The  applicant  contends  he
has evidence his back is “fine” and that the x-rays taken while he was
in the Air Force are wrong.  In support of his appeal,  the  applicant
provided copies of x-rays taken after he was out of the Air force.

AIR FORCE EVALUATION:

Pursuant to the Board’s request, the BCMR Medical Consultant evaluated
the applicant’s current request.  The BCMR  Medical  Consultant  again
recommends denial of the applicant’s request.

In support of  his  appeal,  the  applicant  submits  the  results  of
scoliosis x-ray surveys performed 7 Nov 03 and 10 Dec 03,  which  were
previously submitted and reviewed.  The BCMR Medical Consultant states
that his conclusions and recommendations remain the same as put  forth
in the evaluation dated 17 Sep 04.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 1
Feb 07 for review and comment within 30 days.  To date, a response has
not been received.

THE BOARD CONCLUDES THAT:

After again reviewing the complete evidence of record, we  agree  with
the opinion and recommendation of  the  BCMR  Medical  Consultant  and
adopt his rationale as the basis for our conclusion that the applicant
has not presented sufficient new evidence to  show  he  has  been  the
victim of an error or injustice.  Therefore, we do not find a basis to
change our earlier determination to deny the relief requested.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
