APPLICANT REQUESTS THAT:

Her DD Form 4, Enlistment/Reenlistment Document Armed Forces of  the  United
States, be corrected to reflect Senior Airman (SrA).

APPLICANT CONTENDS THAT:

She held the rank of Airman First Class (A1C) on active duty for  two  years
and two months.  She was brought onto active duty as an A1C with a  date  of
rank (DOR) of 28 December 2005, the  date  she  entered  active  duty.   She
received no adjustment for her active duty time which would  have  made  her
DOR 27 February 2004. She was Palace Chase so she had no  break  in  service
when she came back to active duty.

In support of  her  application,  applicant  submits  a  memorandum  from  4
MSS/DPMP dated 28 June 2006, DD form 214 and e-mail traffic relative to  the
issue.

STATEMENT OF FACTS:

The applicant served on active duty from 7 May  2002  to  15 September  2004
with the highest held grade of A1C. On  28 December  2005  she  returned  to
active duty as an A1C with a DOR of 28  December  2005.   She  is  currently
serving on active duty in the grade of A1C.

AIR FORCE EVALUATION:

AFPC/DPPAES recommends denial. A review of the applicant’s  records  reveals
she did not receive credit for her previous
active duty time. She is entitled  to  a  DOR  adjustment  but  not  to  the
advanced rank of SrA.  AFI 36-2604 states credit should be  made  to  anyone
who was on active duty for more than two years and out less  than  6  years.
Upon computing the member’s dates, she is entitled to a  DOR  correction  to
A1C with a DOR of 27 February 2004 and  AFPC/DPPPWM  has  been  advised  and
will update the DOR accordingly.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was  forwarded  to  the  applicant  on  4
August 2006 for review and comment within 30 days.  As of  this  date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of an error or an injustice.   The  applicant  contends  that  her
rank should be SrA because she served on active  duty  as  an  A1C  for  two
years and two months and did not receive any adjusted credit for her  active
duty time.  A review of the applicant’s  records  reflect  she  was  brought
back on active duty on 28 December 2005, a order was cut  promoting  her  to
SrA effective 28 December 2005,  and  she  tested  for  SSgt  based  on  the
promotion to SrA.   However,  the  system  flipped  her  back  to  Amn.   In
reviewing the Air Force  Instruction  the  applicant  should  have  received
adjusted credit for her active duty time as a A1C.  Therefore,  in  view  of
the foregoing, we believe that any doubt should be resolved in favor of  the
applicant and recommend the  applicant’s  record  be  correct  as  indicated
below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that:

      a.    Her effective date of rank as an airman first class (E-3) is  27
February 2004.

      b.    She was promoted to the grade of senior airman  (E-4)  effective
and with a date of rank of 28 December 2005.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having reviewed and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116) it is directed that:

      The pertinent military records of the Department of the Air Force
relating to           , be corrected to show that:

      a.    Her effective date of rank as an airman first class (E-3) is  27
February 2004.

      b.    She was promoted to the grade of senior airman  (E-4)  effective
and with a date of rank of 28 December 2005.
