APPLICANT REQUESTS THAT:
Her date of rank (DOR) to the grade of staff sergeant be changed from 26
November 2002 to 10 December 2001.

THE APPLICANT CONTENDS THAT:
Her DOR should be changed to reflect her total Air Force time in grade
(TIG).
The applicant states that while on active duty in 2000, she was awarded a
line number for staff sergeant; however, she completed a PALACE CHASE to
the New Hampshire Air National Guard (ANG). Upon enlistment in the ANG,
she was placed in a staff sergeant slot, completed the necessary
Noncommissioned Officer in Charge (NCO) Preparatory Course, and was awarded
a DOR to staff sergeant of 10 December 2001. She returned to the Regular
Air Force on 26 November 2002, in the grade of staff sergeant, with a DOR
and effective date of 26 November 2002.

STATEMENT OF FACTS:
The applicant enlisted in the Air Force Reserve for a period of eight years
on 22 June 1993 under the Delayed Entry Program (DEP).
On 21 October 1993, she was discharged from the DEP and enlisted in the
Regular Air Force for a period of four years.
She reenlisted in the Regular Air Force for a period of four years on 21
February 1997.
She was released from active duty in the grade of senior airman under the
provisions of AFI 36-3208 (Intradepartmental Transfer (ANGUS)) on 10 August
2000, and enlisted in the New Hampshire ANG (NH ANG) in the grade of senior
airman for a period of six years on 11 August 2000.
She completed the NCO Preparatory Course on 27 September 2001.
She was promoted to the grade of staff sergeant, with a DOR of 10 December
2001.
On 25 September 2002, she requested conditional release from the NH ANG
contingent upon her enlistment in the Regular Air Force.
She was honorably discharged from the NH ANG on 25 November 2002, and
enlisted in the Regular Air Force on 26 November 2002, for a period of four
years, in the grade of staff sergeant, with a DOR of 26 November 2002.

AIR FORCE EVALUATION:
AFPC/DPPAOR recommends the application be denied and states, in part, that
the applicant’s DOR was computed correctly based on the governing
directives since she was a reservist who was enlisting in a pay grade
higher than she last held in a regular component.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation, with attachment, was forwarded
to the applicant on 9 May 2003 for review and response within 30 days.
However, as of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice to warrant adjusting the applicant’s date
of rank (DOR) to the grade of staff sergeant. In this respect, we note
that the applicant was released from active duty in the grade of senior
airman and transferred to the NH ANG, where she was promoted to the grade
of staff sergeant, with a date of rank (DOR) of 10 December 2001. She was
discharged from the NH ANG and enlisted in the Regular Air Force (RegAF) on
26 November 2002, in the grade of staff sergeant. The applicant contends
that she should be allowed to retain her 10 December 2001 DOR; however, in
accordance with AFI 36-2604, her DOR was established as the date she
returned to active duty, since she was a reservist enlisting in the RegAF
in a pay grade higher than she last held on active duty. In view of this
and since she has provided no evidence to indicate that her DOR was
improperly computed or contrary to the governing Air Force Instruction, we
find no compelling basis to recommend granting the relief sought.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

The applicant was held in pretrial confinement from 11 November 2002 to 6 February 2003, causing a total lost time of 88 days. The Air Force also did not err in characterizing the time the applicant spent in pretrial confinement as lost time. Therefore, we recommend that the applicant’s records be corrected as indicated below.
