APPLICANT REQUESTS THAT:

His records be corrected to reflect he was awarded the North  Atlantic
Treaty Organization Medal-Yugoslavia (NATO-Y).

APPLICANT CONTENDS THAT:

He was separated from active duty before the medal was awarded.

In support of his request, the applicant provided a  copy  of  his  DD
Form 214 and the criteria for the medal.

Applicant's complete submission,  with  attachments,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force (RegAF) on  15 October
1986, as an airman basic (AB) for a period of four years.

The applicant while on active duty was assigned to Aviano AB, Italy in
1997-1998.

The applicant was honorably discharged on 28 January 1998 in the grade
of staff sergeant (SSgt).  He served 11 years, 3 months and 4 days  of
active duty service.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends the requested relief be denied.   They  state
the NATO-Y has been approved for servicemembers who served under  NATO
command or operational control in direct support of NATO operations in
the former Republic of Yugoslavia, or as designated by Supreme  Allied
Commander, Europe (SACEUR) from 1 July 1992 through a future date that
has  not  been  determined.   They  further  state  the  applicant  is
ineligible for the award because he was officially assigned  to  Italy
and not temporarily assigned in direct support of a NATO operation.

A complete copy of the Air Force evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  19
January 2007, for review and response.  As of this date,  no  response
has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and the recommendation of  the  Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or  an  injustice.   The
applicant is requesting award  of  the  NATO-Y.   The  NATO  medal  is
awarded  for  servicemembers  who  served  under   NATO   command   or
operational  control  in  direct  support  of   NATO   operations   in
Yugoslavia.   The  applicant  was  assigned  to  Italy  and  was   not
temporarily  assigned  in  direct  support  of   a   NATO   operation.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon the
submission of newly discovered relevant evidence not  considered  with
this application.
