APPLICANT REQUESTS THAT:

The Air Force Commendation Medal (AFCM) awarded for  the  period  14 January
2003 to 22 February 2006, be placed in his Officer  Selection  Record  (OSR)
for the Special Board scheduled to convene on 26  June  2006  to  reconsider
him for the Calendar Year 2006 (CY06) Force Shaping Board (FSB).

APPLICANT CONTENDS THAT:

Due to an administrative processing error, the AFCM was not  approved  until
19 April 2006.  As a result of this error, his  records,  as  they  met  the
CY06 FSB, did not show that he  had  received  a  decoration  for  his  last
Permanent Change of Station (PCS).  The accomplishments  for  which  he  was
awarded the decoration occurred well before the CY06  FSB  and  should  have
been reviewed as part of the whole person concept.

In support of the appeal, applicant submits a copy  of  the  special  orders
and citation to accompany award of the AFCM.

STATEMENT OF FACTS:

Applicant is currently  serving  on  active  duty  in  the  grade  of  first
lieutenant.  On 6 July 2005, a Recommendation for Decoration Printout  (RDP)
was prepared on the applicant.  He  was  considered  and  not  selected  for
retention by the CY06 FSB that convened on  10  April  2006.   On  19  April
2006, he was awarded the AFCM, for meritorious  service  during  the  period
14 January 2003 to 22 February 2006.



Due to an anomaly with  some  records  during  the  CY06  FSB,  192  of  the
lieutenants who were not selected for  retention  will  have  their  records
reconsidered by a special board scheduled to convene 26 June 2006.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the application be denied and states,  in  part,  that
the absence of the decoration is not an error since the orders  awarding  it
were not published until after the CY06 FSB  convened.   Thus,  it  did  not
exist when the CY06 FSB convened.  Further,  there  are  no  accomplishments
listed in the AFCM citation that are not reflected in  the  four  OPRs  that
were available for the FSB’s review.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Contrary to the comments of the OPR  that  the  AFCM  did  not  provide  any
additional information to the FSB that was not already in  his  record,  the
FSB was not aware of the fact that he had been recommended for the AFCM.

In further support of the appeal, applicant provides the  first  endorsement
of  Major  General  Zamzow,  Director  of  Air,   Space,   and   Information
Operations, who concurs with his rebuttal comments.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  After thoroughly  reviewing  the  evidence  of  record  and  noting  the
applicant’s contentions, we  are  not  persuaded  that  sufficient  relevant
evidence has been  presented  to  demonstrate  the  existence  of  error  or
injustice.  In this respect, we note the orders awarding the  applicant  the
AFCM were not published until 9 days after the FSB convened.  As  such,  the
decoration did not exist prior to that date and could not be  filed  in  his
records prior to  the  FSB.   The  senior  officer’s  concurrence  with  the
applicant’s rebuttal  comments  is  duly  noted;  however,  this  individual
provides no explanation as to why  the  decoration  was  not  processed  and
approved prior to the FSB.   Therefore,  in  the  absence  of  evidence  the
applicant’s chain of command intended to process the decoration in time  for
the FSB, but the processing of  the  decoration  was  delayed,  we  find  no
compelling  basis  to  recommend  granting  the  relief   sought   in   this
application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
