APPLICANT REQUESTS THAT:

The Air Force Commendation  Medal  (AFCM),  Second  Oak  Leaf  Cluster
(2OLC) awarded to him for the period  21  Aug  98  to  20  Oct  01  be
accepted for file in his Officer Selection Record (OSR) for the  CY05A
Lieutenant Colonel Central Selection Board.

He be considered for promotion to the grade of lieutenant  colonel  by
special selection board (SSB) by the CY05A Lieutenant Colonel  Central
Selection Board with the corrected record.

APPLICANT CONTENDS THAT:

When he returned to  active  duty  after  one  year  in  the  inactive
Reserve,  he  discovered  his  records  had  been  lost  when  he  was
previously on active duty.  When he received the Officer  Preselection
Brief (OPB) for the CY05A Lieutenant Colonel Central Selection  Board,
he observed that it was missing his decoration.  Previous to that,  he
had no reason to believe it was not in his records.  He  notified  the
military personnel flight (MPF), which said they would  take  care  of
it.  However, it did not make it into his records.   He  notified  his
MPF again and it  was  discovered  that  a  decoration  had  not  been
prepared on him and that there was no reason  why.   It  was  just  an
oversight.  A decoration is now being prepared on him.

In support of his appeal, applicant submits two letters from his  wing
commander stating that due to an  oversight,  the  applicant  did  not
receive a decoration and that due to his records  being  misplaced  by
the Air Force, it was not discovered for over three years.

STATEMENT OF FACTS:

The applicant is presently serving on active  duty  in  the  grade  of
major.  His Total Active Federal Military Service Date (TAFMSD) is  13
Nov  91.   According  to  the  military  personnel  data  system,  the
applicant left active duty and entered the Air Force  Reserves  on  21
Oct 01.  He reentered active duty on 14 Nov  02.   The  applicant  was
considered but not selected to the grade of lieutenant colonel by  the
CY05A  Lieutenant  Colonel  Central  Selection  Board  (6   Jul   05).
According to the  Officer  Selection  Brief  prepared  for  the  CY05A
promotion board the applicant had the following decorations  when  the
board convened:

        a.  Air Medal

        b.  Joint Service Commendation Medal

        c.  Air Force Commendation Medal with one oak leaf cluster

        d.  Air Force achievement Medal

The applicant was awarded  the  AFCM  (Second  Oak  Leaf  Cluster)  by
Special Order GA-015, dated 23 Nov 05.

AIR FORCE EVALUATION:

AFPC/DPPPO  recommends  denial  of  the  applicant’s  requests.    The
applicant was awarded the AFCM (2OLC) by Special Order  GA-015,  dated
23 Nov 05, over four months after the CY05A Lieutenant Colonel Central
Selection Board  convened.   Given  the  date  of  the  special  order
awarding the decoration, the citation could not have been filed in the
applicant’s OSR nor reflected in the official personnel  data  systems
when the board convened.

AFPC/DPPPO has attached copies  of  the  special  order  awarding  the
decoration, the decoration citation, and the applicant’s OSB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
13 Jan 06 for review and comment within 30 days.  To date, a  response
has not been received.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by  existing  law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate  the
existence of error or injustice.  The Board notes the  support  of  the
applicant’s current commander and his confirmation that the applicant’s
decoration was not processed in a timely manner due  to  administrative
oversight.  Although the applicant was awarded his decoration after the
promotion board had convened, we believe it constitutes an injustice to
him for it not to be included in his officer selection  record.   While
it  cannot  be  conclusively  stated  that   the   missing   decoration
contributed to his nonselection for promotion, he at least deserves the
opportunity to be considered  with  a  complete  and  accurate  record.
Therefore, we recommend his records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of  the  Department  of  the  Air  Force
relating to APPLICANT be corrected to show that:

         a.  Special  Order  GA-015  awarding   him   the   Air   Force
Commendation Medal for the period 21 Aug 98 to 20 Oct 01 be dated 1 Jun
05 vice 23 Nov 05.

        b.  The citation for the Air Force Commendation  Medal  (Second
Oak Leaf Cluster) awarded to him for the period 21 Aug 98 to 20 Oct  01
be dated 1 Jun 05 vice 23 Nov 05.

        C.  The Air Force Commendation Medal (Second Oak Leaf  Cluster)
awarded to him for the period 21 Aug 98 to 20 Oct 01 was  accepted  for
file in his officer selection record on or before 1 Jul 05.

The applicant be considered for promotion to the  grade  of  lieutenant
colonel by special selection  board  (SSB)  for  the  CY05A  Lieutenant
Colonel Central Selection Board with the corrected record.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

      The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that:

             a.  Special  Order  GA-015  awarding  him  the  Air  Force
Commendation Medal for the period 21 Aug 98 to 20 Oct 01 be dated 1 Jun
05 vice 23 Nov 05.
