APPLICANT REQUESTS THAT:
His records be corrected to reflect the Korean Service Medal and the Air
Force Overseas Ribbon - Short Tour (AFOR-ST).

THE APPLICANT CONTENDS THAT:
He served in both Korea and the Republic of Vietnam and would like his
records to reflect this service. He has earned these medals by serving in
these countries.
In support of his request, applicant provides a copy of a TDY order.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force in the grade of airman
basic (E-1) on 18 July 1960. He was progressively promoted to the grade of
airman first class (E-4) effective 1 February 1964. Applicant’s records
reflect Japan as overseas service.
The applicant was honorably released from active duty on 7 July 1964 and
transferred to the Air Force Reserve for completion of his military service
obligation. He was credited with 3 years, 11 months and 20 days of
continenetal service of which 1 year, 5 months and 26 days were foreign
service.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial. DPPPR states to be eligible for the KDSM,
personnel must have been physically present in the areas (Republic of Korea
(ROK) and surrounding waters after 28 July 1954 to a date to be determined)
for 30 consecutive days or 60 nonconsecutive days. DPPPR advises the
applicant served in Korea for 26 days; therefore, he is ineligible for the
KDSM.
DPPPR advises that to be awarded the AFOR-ST, the applicant's foreign
service must have been before 6 January 1986 with completion of an overseas
tour on or after 1 September 1980. The applicant's date of separation, 7
July 1964, is out of the range of the authorized criteria date. The
AFPC/DPPPR complete evaluation, with attachments, is at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant states he does not understand how he only served in Korea for 26
days. His Special Order reads "approximately 30 days" which required him
to serve at three different Air Bases (Osan, Kimpo and Kunsan) and he
believes his time in Korea was more like 45 days. Applicant’s complete
response, with attachment, is at Exhibit D.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We find no evidence of error in this case
and after a thorough review of the documentation that has been submitted in
support of his appeal, we do not believe that he has suffered an injustice.
Other than his own assertions, we find no evidence, which would lead us to
believe that he served the required period of time to be eligible for the
Korean Defense Service Medal. However, should the applicant have
documentation to substantiate his presence in Korea for 30 consecutive days
or 60 nonconsecutive days, he may, of course, submit another request and
the Board will review this new evidence. In the absence of the required
documents, which would show he met the qualifications for award of the
Korean Service Medal, favorable consideration of his request is not
justified. In regard to the applicant's request for the Air Force Overseas
Ribbon-Short Tour, it is our opinion since the applicant's date of overseas
tour is not within the authorized criteria date, favorable consideration of
his request for this award is not warranted. Therefore, in the absence of
evidence to the contrary, we find no basis upon which to recommend
favorable consideration of this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.

On 5 Sep 07, the applicant submitted an additional response with a notarized statement from a former military member who served with him during his assignment in Thailand. As of this date, this office has received no response (Exhibit H). In regards to the other decorations requested, we note that the Air Force office of primary responsibility has verified the applicant’s entitlement and has administratively corrected his record to reflect them.
