His enlistment grade be changed to private first class.

APPLICANT CONTENDS THAT:
Upon arrival at his first duty station, Amarillo AFB, he was asked why he
didn’t arrive with two stripes at the time of in-processing.
In support of his request, the applicant provided documentation extracted
from his military personnel records.

STATEMENT OF FACTS:
Applicant enlisted in the Illinois Army National Guard on 24 May 1955 and
discharged in the grade of private first class on 6 January 1957 after
serving 1 year, 7 months, and 13 days of active duty service. On 7 January
1957 he enlisted in the Regular Air Force in the grade of airman basic. A
DD Form 4, Enlistment Record – Armed Forces of the United States, reflects
the applicant’s enlistment grade as airman basic and he initialed his
understanding of his enlistment grade.

AIR FORCE EVALUATION:
AFPC/DPPAES recommends denial. DPPAES states the applicant enlisted in the
correct grade of airman basic and was fully aware of his enlistment grade
as shown by his initials on the DD Form 4. Additionally, the applicant’s
request is untimely and the Board should consider dismissal of his claim.
The applicant’s decision to wait 23 years of active service coupled with 28
years of retirement has greatly hampered the Air Forces position to
properly evaluate his claim.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 14 July 2006, the evaluation was forwarded to the applicant for review
and comment within 30 days. As of this date, this office has received no
response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. After reviewing the evidence of
record, we agree with the Air Force that the applicant’s enlistment grade
of airman basic is correct. Since the applicant initialed the DD Form 4 we
believe he was fully aware of his enlistment grade. Further, he has
provided no evidence indicating otherwise. Therefore, we agree with the
opinion and recommendation of the Air Force and adopt its rationale as
basis for our conclusion that he has not been the victim of an error or
injustice. Based on the available evidence of record, we find no
compelling basis to recommend granting the relief sought.

The applicant be notified the evidence presented did not demonstrate the
existence of an error or an injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.
