APPLICANT REQUESTS THAT:
1. His duty title be changed from Orbital Safety Officer to Chief,
Orbital Safety, effective 12 July 2005.
2. His records be corrected to reflect the Air Force Commendation Medal
(AFCM) effective 7 August 1997.
3. His corrected record be considered for promotion to the grade of
major by the Calendar Year 2005A (05 Dec 05) Major Central Selection Board.

THE APPLICANT CONTENDS THAT:
The incorrect duty title was not listed on the Air Force Officer
Preselection Brief (OPB) he reviewed, but was listed on the brief reviewed
by the selection board which represents a subordinate position. The
missing AFCM is listed as awarded, but no hard copy exists. Therefore, the
selection board was unable to consider it for promotion purposes.
In support of his appeal, the applicant submits a copy of his duty history
information and a copy of his AFCM citation with special orders.

STATEMENT OF FACTS:
Information extracted from the Military Personnel Data System (MilPDS)
indicates the applicant’s Total Active Federal Military Service as 1
February 1993. He is currently serving on active duty in the grade of
captain, with a date of rank and an effective date of 8 August 2001. As of
11 May 2006, the MilPDS reflects his duty title as “Chief, Orbital Safety”
effective 12 July 2005.
The applicant’s Officer Selection Record (OSR) contains AF Forms 707B,
Officer Performance Reports (OPRs) beginning with the rating period 19
November 2000 and ending on 23 January 2005 with overall ratings of “Meets
Standards.” The applicant received an AF Form 475, Education/Training
Records, documenting his completion of 1 SOPS DSP SVO/SSO Initial
Qualification Training. During these rating periods, the applicant
received an AF Form 709, Promotion Recommendation Form, for the P0405B
Selection Board and received an overall recommendation of “Promote.” In
addition, the applicant’s OSR contains two Air Force Achievement Medals for
the periods 20 November 2001 to 15 November 2002 and 29 November 2001 to 31
March 2002; a discrepancy report for the Air Force Commendation Medal for
the period 24 May 1993 to 7 August 1997 and an AFCM, First Oak Leaf
Cluster, for the period 25 November 1998 to 31 October 2001.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends the application be denied. DPPPO states that
although the applicant’s OSB reflected the incorrect duty history data, his
respective PRF contained the correct information, which the board members
saw and took into consideration in evaluating his record. Therefore, the
corrected duty history data does not introduce any new information that was
not already considered by the board members. Additionally, DPPPO
recognizes the applicant’s AFCM citation was not reflected in his OSR,
however, the medal was reflected on his OSB. DPPPO advises that it is the
officer’s responsibility to ensure the accuracy of his record. The errors
on his OSB were discoverable and fixable had the applicant carefully
reviewed his OPB prior to the board. The DPPPO evaluation is at Exhibit C.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:
Applicant states that after receiving his non-select counseling, he has
concluded that these documentation errors taken individually would likely
not have affected the outcome of the selection board. As a whole, however,
it is reasonable to believe that an incomplete record could have swayed the
board in one direction or another especially considering a 93 percent
selection rate and his strong record of performance.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We have reviewed the available evidence
pertaining to the applicant’s assertions related to his incorrect duty
title and Air Force Commendation Medal (AFCM). While it appears the
citation for the applicant’s AFCM was missing from his selection record, we
note there was a discrepancy letter filed in his OSR. Therefore, it is our
opinion the selection board was aware of the fact that he had been awarded
the AFCM effective 7 August 1997. In regard to the incorrect duty title,
we note the applicant’s Promotion Recommendation Form contained the correct
duty title, which the board members saw and took into consideration in
evaluating his record. Hence, we find the selection board had at its
disposal a sufficiently accurate record on which to base its decision
concerning the applicant’s promotability in relation to his peers. In view
of the above, we find no basis to recommend granting the relief sought in
this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
