APPLICANT REQUESTS THAT:
He be considered for promotion to lieutenant colonel by a Special
Selection Board (SSB) for the CY00A (28 Nov 00) Central Lieutenant
Colonel Selection Board (P0500A), with a corrected Officer
Preselection Brief (OPB).

APPLICANT CONTENDS THAT:
The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.
In support of his request, the applicant submits a copy of his Officer
Preselection Brief (OPB) and additional documents associated with the
issues cited in his contentions. The applicant’s complete submission,
with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant’s Total Active Federal Military Service Date (TAFMSD) is
20 Jul 84. He is currently serving on active duty in the grade of
major, with an effective date and date of rank of 6 Oct 92.
The applicant received 10 Officer Performance Reports (OPRs) in the
grade of major, in which the overall evaluations were “Meets
Standards.” He was considered and nonselected for promotion to the
grade of lieutenant colonel by the CY97B (2 Jun 97), CY97E (8 Dec 97),
CY 99A (19 Apr 99), CY99B (30 Nov 99), CY00A (28 Nov 00) and CY01B (5
Nov 01) Central Lieutenant Colonel Selection Boards.
The remaining relevant facts pertaining to this application, extracted
from the applicant’s military records, are contained in the letter
prepared by the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:
HQ AFPC/DPPPO recommends the application be denied. DPPPO reviewed
the applicant’s Officer Selection Record (OSR) that met the CY00A
selection board and found that not only did his Officer Selection
Brief (OSB) reflect the correct number of Meritorious Service Medals
(MSMs) and Air Force Commendation Medals (AFCMs) awarded, but his OSR
also contained the correct citations for the MSMs (MSM, 2OLC) and
AFCMs (AFCM, 2OLC). DPPPO stated that, since both his OSR and OSB
were correct, SSB consideration is not warranted. The HQ AFPC/DPPPO
evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the advisory opinion and indicated that the
basis for his request for corrective action is an inaccurate Officer
Preselection Brief (OPB) that was presented to the 0500A Lieutenant
Colonel JAG Central Selection Board. The OPB he received reflects an
incorrect number of MSMs and AFCMs. The correct numbers should have
been 3 MSMs and 3 AFCMs. The applicant’s response, with attachment, n
is at Exhibit D.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After thoroughly reviewing the
evidence of record and noting the applicant’s complete submission, we
agree with the opinion and recommendation of the appropriate Air Force
office of primary responsibility and adopt the rationale expressed as
the basis for our decision that the applicant has failed to sustain
his burden that he has suffered either an error or an injustice.
Although the applicant’s Officer Preselection Brief (OPB) may have
been inaccurate, it is a document forwarded to officers for their
review and updating as needed, it is not a document a selection board
reviews. We noted that, at the time the applicant was considered for
promotion by the CY00A Central Lieutenant Colonel Selection Board,
both his Officer Selection Brief (OSB) and Officer Selection Record
(OSR) were correct. In view of the above and absent evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
