APPLICANT REQUESTS THAT:

He be considered for  promotion  to  the  grade  of  lieutenant  colonel  by
Special Selection Board (SSB)  for  the  CY01B  Central  Lieutenant  Colonel
Selection Board.

APPLICANT CONTENDS THAT:

His Officer Selection Record  (OSR)  contained  an  order  that  erroneously
indicated award of the Air Force Commendation Medal (AFCM) second  oak  leaf
cluster (2OLC) when it should have reflected one AFCM (1OLC).  In  addition,
his OSR did not include his 24  May  01  change  in  organization  and  duty
title.

In support of his request, the applicant provided  a  copy  of  his  Officer
Preselection Brief (OPB), a copy of  an  officer  Single  Uniform  Retrieval
Format (SURF), a copy of his AFCM, a copy of  special  order  GB-33,  and  a
copy of special order GB-221.  His complete  submission,  with  attachments,
is at Exhibit A.

STATEMENT OF FACTS:

The applicant was appointed a captain, Reserve of the Air Force, on  12  Mar
88 and was voluntarily ordered to extended active duty on  that  same  date.
He was integrated into the Regular Air Force on 26  Jan  94.   He  has  been
progressively promoted to the grade of  major,  having  assumed  that  grade
effective and with a date of rank of 1 Jul 95.  He was  considered  and  not
selected for promotion to the grade of lieutenant colonel by the  CY99B  (30
Nov 99), CY00A (28 Nov 00), and the CY01B  (5  Nov  01)  Central  Lieutenant
Colonel Selection Boards.

AIR FORCE EVALUATION:

AFPC/DPPPO  reviewed  applicant's  request  and  recommends  denial.   DPPPO
states that the order for the AFCM was not  filed  in  his  OSR.   Normally,
orders granting a decoration are not filed in the OSR when the  citation  is
available.  In this case, the citation was available and filed in  his  OSR.
Since the board members had a copy of the correct  citation  to  review  and
were aware of the level of the award, SSB consideration is not warranted.

Regarding his contention that his duty title, effective 24 May 01,  was  not
included in his record, DPPPO disagrees and states that his  top  line  duty
title data was reflected on his Officer Selection Brief (OSB)  when  it  met
the board.

Although not requested in his application, DPPPO states  that  there  is  an
incorrect annotation in the  decorations  area  of  his  OSB.   The  correct
number of AFCMs is two, not three.  However,  central  boards  evaluate  the
entire OSR assessing whole person factors.   The  selection  board  had  his
entire OSR during promotion consideration.  DPPPO is not convinced that  the
incorrect number of AFCMs annotated on his OSB caused his  nonselection  for
promotion.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 26  Jul
02 for review and comment within 30 days.  As of this date, this office  has
received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of  error  or  injustice.   We  took  notice  of  the  applicant's
complete submission in judging the merits of the case.  However, we are  not
persuaded by the evidence presented in support of his  appeal  that  he  was
denied a fair opportunity to compete successfully for  promotion.   In  this
regard, we note that the  AFCM  filed  in  his  selection  record  correctly
reflected the first oak leaf cluster and that his  officer  selection  brief
contained his most current duty information.  Therefore, we agree  with  the
opinion  and  recommendation  of   the   Air   Force   office   of   primary
responsibility and adopt their rationale as the  basis  for  our  conclusion
that the applicant has not been the victim of an  error  or  injustice.   In
the absence of persuasive evidence to the contrary, we  find  no  compelling
basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
