STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force (RegAF) on 13 November
1951, as a private for a period of four years.
The applicant’s Air Force (AF) Form 7 reflects he was awarded the
National Defense Service Medal (NDSM), United Nations Service Medal
(UNSM), Korean Service Medal (KSM), Air Force Outstanding Unit Award
(AFOUA), AFOUA with one Bronze Oak Leaf Cluster (OLC), Air Force
Longevity Service Award (AFLSA), AFLSA with one Bronze OLC, Good
Conduct Medal (GCM), Small Arms Expert Marksmanship Ribbon (SAEMR),
AFLSA with two Bronze OLCs, Air Force Good Conduct Medal (AFGCM),
Vietnam Service Medal (VSM), VSM with one Bronze Service Star (BSS).
The applicant retired on 1 August 1972 in the grade of technical
sergeant (TSgt). He served 20 years and 8 months and 18 days of
active duty service.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends the requested relief be denied. DPPPR states
the CAR is awarded to servicemembers of the United States (U.S.) Navy,
the U.S. Marine Corps, and the U.S. Coast Guard, operating under the
control of the U.S. Navy, in the grade of 0-6, or below, who have
actively participated in ground or surface combat. Upon submission of
evidence to their commanding officer, personnel who earned the Combat
Infantryman Badge or Combat Medical Badge wile member of the U.S. Army
may be authorized to wear the CAR instead.
The applicant has not submitted any additional documentation to
support his claim for the CAR. No official records have been located
to verify the applicant was awarded the CAR.

Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant and
counsel on 3 March 2006, for review and response within 30 days. As
of this date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to waive the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and the recommendation of the Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or an injustice. The
Combat Action Ribbon is awarded to servicemembers in the U.S. Navy,
Marines and Coast Guard. In reviewing the applicant’s military
records no official documentation was found showing the applicant
served in a branch of service awarding the Combat Action Ribbon.
There was no evidence found to verify the applicant was awarded the
Combat Action Ribbon, nor has he provided any documentation
substantiating he was awarded the Combat Action Ribbon. In view
of the foregoing, and in the absence of evidence to the contrary, the
Board finds no basis to grant the requested relief.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

Applicant’s military personnel records reveal that, on 3 December 1970, the Directorate of Awards and Decorations, HQ Numbered Air Force, disapproved the proposed decoration recommendation for all four members. As of this date, no response has been received by this office (Exhibit D). In this respect, we note that the Award Board disapproved the Air Medal recommendation on 3 December 1970.
