APPLICANT REQUESTS THAT:
He be considered for promotion to the grade of colonel by Special Selection
Boards (SSBs) for the CY03B and CY04C Colonel Central Selection Boards to
correct assignment errors.

STATEMENT OF FACTS
The applicant is serving on active duty in the grade of lieutenant colonel.
The applicant has two non-selections to the grade of colonel by CY03B and
CY04C Colonel Central Selection Boards.
On 16 March 2005, the applicant requested he be considered for promotion to
the grade of colonel by Special Selection Boards (SSBs) for the CY03B and
CY04C Colonel Central Selection Boards to correct assignment errors was
considered and denied by the Board. For accounting of the facts and
circumstances surrounding the applicant's request, and, the rationale of
the earlier decision by the Board, see the Record of Proceedings at Exhibit
G.
On 28 March 2006, the applicant submitted a request for reconsideration.
To support his request, he provided letters of support from previous
raters. The applicant's complete submission, with attachments, is at
Exhibit H.

THE BOARD CONCLUDES THAT:
1. After again reviewing this application and the additional evidence
provided in support of his appeal, we remain unpersuaded that the applicant
has been the victim of an error or injustice. We carefully considered the
statements provided by the applicant and while we believe the evidence to
be new and relevant, it does not provide a sufficient basis to alter our
original decision. In the final anaylsis, the underlying relief applicant
seeks is something the Board is powerless to grant; i.e., directing an SSB
board to think a certain way or to interpret his record in a particular way
that would result in his winning a promotion. Accordingly, we find no
basis upon which to favorably consider the requested relief.
2. The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue involved. Therefore, the request for a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
