APPLICANT REQUESTS THAT:

He be considered for promotion to the grade  of  major  by  special
selection board (SSB) for the CY04A Major Central  Selection  Board
(1 Nov 04) (P0404A) with his Air Force Commendation  Medal  (AFCM),
Second Oak Leaf Cluster (2OLC), and his Aerial  Achievement  Medals
(AAMs), Basic, First and Second Oak Leaf Clusters, included in  his
officer selection record (OSR).

APPLICANT CONTENDS THAT:

These decorations were approved and dated after the board  convened
on 1 Nov 04.  The AFCM (2OLC) was  for  the  period  26  Jul  03  –
17 Nov 03, and was approved on 13 Dec 04; was earned while deployed
and was originally sent up as a joint medal.  He was told later  it
took a long time to process because he was in a  joint  billet  and
had to wait for it to revert to an AFCM, resulting in  an  approval
date after the board convened.

The AAMs were for actions from 12 Oct 01  –  24 Sep  02,  7  Jan  –
12 Apr 03, and 22 Mar 03 – 17 May 04, which were all approved after
the 04 Major Selection Board  convened  and  not  included  in  his
promotion package for the board’s review.

After Sep 11 [01], his squadron shutdown several offices and it was
not until recently that  the  awards  and  decorations  office  was
reopened, resulting in these medals being submitted well after they
were earned.  He  requests  the  medals  be  dated  closer  to  the
achievements they were awarded for in order to get them into his 04
Major Selection Board OSR.

In  support  of  his  appeal,  applicant  provided  copies  of  the
citations  and  special  orders  accompanying  award  of  the  AFCM
(2OLC)and the three AAMs.

STATEMENT OF FACTS:

The applicant is currently serving in the grade of captain, with  a
date of rank of 29 May 00, with a Duty Title of Flight Commander/T-
37 IP.

Applicant was nonselected for promotion by the CY04A Major  Central
Selection Board which convened on 1 Nov 04.

The awards in question were awarded as follows:

      AFCM (2OLC) for outstanding achievement during the period  26
Jul 03 to 17 Nov 03, awarded per special order, dated 13 Dec 04.

      AAM for sustained meritorious achievement while participating
in aerial flight from 12 Oct 01 to 24 Sep 02, awarded  per  special
order, dated 10 Jan 05.

       AAM(1OLC)  for  sustained  meritorious   achievement   while
participating in aerial flight during the period 7 Jan 03 to 12 Apr
03, awarded per special order, dated 7 Jan 05.

       AAM(2OLC)  for  sustained  meritorious   achievement   while
participating in aerial flight during  the  period  22  Mar  03  to
17 May 04, awarded per special order, dated 12 Jan 05.

AIR FORCE EVALUATION:

HQ AFPC/DPPPO reviewed this application and recommended denial  for
special selection board consideration.  In accordance with AFI  36-
2803,  Para  3.1.,  decoration  recommendations  are  entered  into
official channels within two years and awarded within  three  years
of  the  act,  achievement,  or  service  performed.    Since   the
AFCM(2OLC) was awarded on 13 Dec 04, and the AAMs (Basic, 1OLC, and
2OLC) were awarded on 10 Jan 05, 7 Jan 05, and  12  Jan  05,  these
documents were in fact processed in a  timely  manner.   Backdating
the special orders to a date prior to the central  selection  board
(CSB) would be a departure from current Air Force policy, and  they
do not  see  any  compelling  reason  to  grant  the  applicant  an
exception in this regard.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant’s commander provided a statement in  his  behalf  stating
that although the opinion is correct considering acceptable  awards
processing  time  IAW  AFI  36-2803,   he   respectfully   requests
applicant’s case be reconsidered due to the  fact  the  application
involves multiple decorations and that the applicant met the  Major
Central Selection Board (PO404A) without these decorations  in  his
record.

He states without the four decorations in question (including three
AAMs awarded in support of Operation  ENDURING  FREEDOM,  Operation
IRAQI FREEDOM, and the  Global  War  on  Terror  and  an  AFCM  for
deployed operations in support of USCENTCOM) in  his  records,  the
applicant met the selection board with only one AFCM  and  was  not
selected for promotion.  He feels the absence of these  awards  did
not give the selection board an  accurate  picture  of  applicant’s
accomplishments and  may  have  made  the  difference  between  his
selection/non-selection for promotion.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing
law or regulations.

2.  The application was timely filed.

3.  Insufficient  relevant   evidence   has   been   presented   to
demonstrate the existence of error or injustice.  We took notice of
the applicant's complete submission in judging the  merits  of  the
case, including the statement submitted in his behalf from his wing
commander.  In this respect, we note that the  awards  in  question
were all issued subsequent to the  CY04A  Major  Central  Selection
Board which convened on 1 Nov 04; the AFCM in Dec 04, and the three
AAMs in Jan 05.  By regulation, they were not required to be  filed
in the applicant’s records until 60 days  after  the  date  of  the
special orders.  The convening dates of selection boards are widely
publicized.  Therefore, it was incumbent upon the  members  of  the
applicant’s rating chain to follow the processing of  these  awards
and insure they reached his selection folder prior to the convening
of the promotion board, if they desired them to be  considered.   A
review of the evidence  provided  did  not  persuade  us  that  any
attempt was made by either the applicant  or  the  members  of  his
rating chain to insure that the AFCM and AAMs were included in  the
applicant’s selection folder for  consideration  by  the  selection
board.  Nor were we persuaded that the  processing  of  the  awards
took an inordinate amount of time.  In view of the  foregoing,  and
in the absence of evidence to the contrary, we find  no  compelling
basis to recommend granting the requested relief.

THE BOARD DETERMINES THAT:

The applicant be notified  that  the  evidence  presented  did  not
demonstrate the existence of material error or injustice; that  the
application was denied without a personal appearance; and that  the
application will only be reconsidered upon the submission of  newly
discovered relevant evidence not considered with this application.
