APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM) and that
it be added to his DD Form 214, Report of Separation from Active
Duty.

APPLICANT CONTENDS THAT:
The AFEM was not listed on his DD Form 214.
In support of his application he submits a copy of his DD Form 214.

STATEMENT OF FACTS:
The applicant served on active duty in the Regular Air Force from
29 May 71 to 28 May 75. His DD Form 214 reflects he served 1 year,
5 months, and 20 days of Foreign Service. He was awarded the
National Defense Service Medal and the Air Force Good Conduct
Medal.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends the applicant’s request be denied. The
applicant served in Taiwan during the period of November 1973 to
July 1974. No other foreign service is listed or documents were
submitted to support an area of eligibility for the AFEM. The AFEM
is awarded to members who, after 1 July 1958, have participated in
United States military operations and encountered foreign armed
opposition, or were in danger of hostile action by foreign Armed
Forces.
Applicant’s performance reports reflect his foreign service was to
Tainan AB, Taiwan. Applicant is not eligible for award of the AFEM
for that tour of duty.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 5 Aug 05, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice of
the applicant's complete submission in judging the merits of the
case; however, we agree with the opinion and recommendation of the
Air Force office of primary responsibility and adopt its rationale
as the basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
