APPLICANT REQUESTS THAT:
His records be corrected to make him eligible to receive a Career Status
Bonus (CSB).

APPLICANT CONTENDS THAT:
He was not notified that he was eligible for the CSB until after he served
16 years in the Air Force.

STATEMENT OF FACTS:
Applicant enlisted in the Regular Air Force on 3 March 1989. His Date
Initially Entered Uniformed Service (DIEUS) date was established as 3 March
1989. He was progressively promoted to the grade of technical sergeant
with an effective date of rank of 1 May 2002.
If a member does not have eligibility or has not made an election for CSB
by the 16th year of active service, the member will remain in High-3/50%
retirement plan. Notification should be provided on or before the date the
member completes 14 years and 6 months of active duty. The applicant’s 14
years and 6 months of active duty was 3 September 2003 with a 15-year point
of active duty of 3 March 2004.

AIR FORCE EVALUATION:
AFPC/DPPRR recommends denial. Based on Air Force policy, the applicant’s
window of opportunity is past suspense and he is no longer eligible for
this program. The applicant does not provide information whether he
inquired to his servicing military personnel flight (MPF) regarding CSB
eligibility at anytime in the past two years.
DPPR states the MPF handled the applicant’s submission properly.
Information and criteria for this program is available through many sources
to include, but not limited to the MPF, DoD and AFPC websites, and Base
Career Advisors.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 20 May
05 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an injustice warranting corrective action. Applicant states
he was not notified by Air Force officials of his CSB eligibility until his
window of opportunity had expired. The Board believes, since the applicant
is a recruiter and was geographically separated from his Unit during his
election window, it is possible he was not notified of his eligibility for
the CSB. The applicant has indicated if he was given the opportunity he
would have elected to receive the CSB. Therefore, since it appears he was
not properly notified, in order to offset the possibility of an injustice,
the fairest and most equitable resolution would be to resolve any doubt in
this matter in his favor. Accordingly, we recommend that the records be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that on 2 January 2004, he was notified
of his eligibility to receive the career status bonus and on 3 January
2004, he elected to receive the career status bonus as a single lump sum
payment.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 2 January 2004, he was
notified of his eligibility to receive the career status bonus and on
3 January 2004, he elected to receive the career status bonus as a single
lump sum payment.
