APPLICANT REQUESTS THAT:
The letter of reprimand (LOR) dated 23 Jul 04, be voided from his
records.

APPLICANT CONTENDS THAT:
He was wrongly served an LOR for standing up for his personnel,
which also generated other unjust actions against him.
In support of his request, the applicant provided his personal
statement, and copies of the contested LOR and associated
documents, and a memo for record from one of his subordinates.

STATEMENT OF FACTS:
Applicant is currently serving on active duty in the grade of chief
master sergeant, with a date of rank of 1 July 2005.
The applicant received an LOR on 23 Jul 04 for using an expletive
during a detachment AETC IG team outbrief on 18 Jun 04. On 23 Jul
04, the applicant submitted comments on his own behalf in response
to the LOR.

AIR FORCE EVALUATION:
HQ AFPC/DPFF recommends the applicant’s request be denied, and
states, the LOR was executed in accordance with applicable
guidelines. AFI 36-2907, Unfavorable Information File (UIF)
Program, paragraph 3.1, clearly states that commanders,
supervisors, and other persons in authority can issue
administrative counselings, admonitions, and reprimands. These
actions are intended to improve, correct, and instruct subordinates
who depart from standards of performance, conduct, bearing, and
integrity, on or off duty, and whose actions degrade the individual
and unit’s mission.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 3 Jun 05, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice of
the applicant's complete submission in judging the merits of the
case; however, we agree with the opinion and recommendation of the
Air Force office of primary responsibility and adopt its rationale
as the basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
