APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:
Award of the AFEM was awarded to his unit for service in Panama, Operation
Just Cause (OJC) in 1989, and was not annotated on his DD Form 214,
Certificate of Release or Discharge from Active Duty.

STATEMENT OF FACTS:
On 25 February 1987, the applicant enlisted in the Regular Air.
On 12 March 1990, the applicant was honorably discharged in the grade of
senior airman under the provisions of AFR 39-10 - Early Separation Program
- Strength Reduction. He served 3 years and 18 days of total active duty
service.
The applicant’s DD Form 214 indicates he received the following decorations
and medals: the Air Force Training Ribbon and the Air Force Outstanding
Unit Award Ribbon.

AIR FORCE EVALUATION:
AFPC/DPPPR recommended denial indicating the AFEM was established on 4
December 1961, to be awarded to members of the United States Armed Forces
who, after 1 July 1958, have participated in United States military
operations and encountered foreign armed opposition, or were in danger of
hostile action by foreign Armed Forces. The Director of Assignments
verified the applicant served in Panama from 1 November 1989 to 31 December
1989. The AFEM was awarded to military personnel that were assigned or
attached to Panama in direct support of OJC from 20 December 1989 to 31
January 1990. The applicant was deployed to Panama in support of OJC from
1 November 1989 to 31 December 1989. The applicant only served 11 days in
OJC not the required 30 days, which makes him ineligible for award of the
AFEM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the evaluation and indicated he served in Panama 60
consecutive days from 1 November to 31 December 1989. He feels it would be
unjust not to award him the AFEM as he did faithfully serve his country.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or an injustice. After thoroughly reviewing the
evidence of record, we find no evidence to show that the applicant is
entitled to award of the AFEM. The AFEM was awarded to military personnel
that were assigned or attached to Panama in direct support of OJC from 20
December 1989 to 31 January 1990. The applicant was deployed to Panama in
support of OJC from 1 November 1989 to 31 December 1989. He served 11 days
in OJC which makes him ineligible for the award of the AFEM. Therefore, in
the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought.

The applicant be notified the evidence presented did not demonstrate the
existence of an error or an injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.

The applicant’s military records show that he was honorably discharged from the Marine Corps on 30 March 1981 while serving in the pay grade of E-5 as a food service specialist.
