APPLICANT REQUESTS THAT:

He be  given  Special  Selection  Board  (SSB)  consideration  by  the
Calendar Year  2004B  (CY04B)  Lieutenant  Colonel  Central  Selection
Board, with a corrected Officer Selection Brief (OSB).

APPLICANT CONTENDS THAT:

His OSB that met the CY04B Lieutenant Colonel Central Selection  Board
incorrectly reflected his organization name/type data as “FLT” instead
of “HQ” for the 31 July 2002  and  the  15  December  2002  assignment
entries and believes the error had a negative impact on his  promotion
opportunity to the grade of lieutenant colonel.

In support of his request, the applicant submitted a copy of  his  OSB
for the CY04B Lieutenant Colonel Central Selection Board, AF Form  IMT
709, Promotion Recommendation, and a copy of a Personal Data printout.

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of  major.   Applicant  was  considered  and  not  selected  for
promotion to the grade of lieutenant colonel by  the  CY04B  selection
board that convened on 12 July 2004.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends denial.  DPPPO states after careful review, they
determined a material error did not exist in  the  applicant’s  record
and trust the results of the original board were based on  a  complete
review of the applicant’s entire  selection  record,  assessing  whole
person factors such as job performance, professional qualities,  depth
and breadth of experience, leadership and education.

DoD policy states that an SSB  shall  not  convene  if  by  exercising
reasonable diligence, the officer should have discovered the error  or
omission and could have taken corrective action before the  originally
scheduled board convened; DPPPO believes he did not.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
22 Apr 05, for review and comment within 30 days.  As  of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or  injustice.   Applicant  contends  that  his
records were not fairly assessed because his Officer  Selection  Brief
(OSB) incorrectly reflected his organization data as flight instead of
headquarters.  The Air Force has indicated that the board members  had
before  them  information  which  showed   his   assignment   at   the
headquarters level.  Therefore, the board members were  aware  of  his
assignment history.  Central boards evaluate the entire officer record
and it is highly unlikely that the incorrect organization level on the
OSB was the cause of his nonselection.  Furthermore,  we  believe  the
applicant could have been more diligent  to  discover  the  error  and
taken action  to  correct  the  OSB  prior  to  the  board  convening.
Therefore, we agree with the opinion and  recommendation  of  the  Air
Force office of primary responsibility and adopt  their  rationale  as
the basis for our conclusion that  the  applicant  has  not  been  the
victim of an error or injustice.  Therefore, we  find  no  basis  upon
which to recommend favorable action on this application.

4.    The applicant's case is adequately documented  and  it  has  not
been shown that a personal appearance with  or  without  counsel  will
materially  add  to  our  understanding  of  the  issue(s)   involved.
Therefore, the request for a hearing is not favorably considered.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
